<br />Olmsted, Ohio, the receipt of which is hereby acl;rowledged, the undersigned
<br />Donald F. Gates and Wanda H. Qates, HusbaMd and Wife
<br />do hereby grant unto the City of North Olmsted, Ohio, an easement over and through
<br />tho following described lands, of which said grantor(s) warrant they are the Owners
<br />in fee simple, situated in the City of North Olmsted, County of Cuyahoga and State

<br />deep on the Southerly line, as measured iron the center line of

<br />said plat, be the same Wore or less, but subject to all legal highways.
<br />The above easement is granted for the purpose of constructing, maintaining and
<br />operating a storm drain, together with the necessary manholes, for the transportation
<br />of surface-water with the right of unimpaired access to said storm drain the rights
<br />of inhress and egress, on, over and through said land for all purposes necessary and
<br />incident to the construction, operation and maintenance and from time, to time, alter,
<br />repair, or remove the same.
<br />The Grantor(s) herein reserve the right to fully use and enjoy said premises
<br />for all purposes consistent with the full use and enjoyment by the grantee of the
<br />easement herein granted. The construction of structures a"s defined in the Grantees
<br />Building Code, except public utilities, is prohibited directly over the scorn drain.
<br />Grantee shall have the right to change the size of its storm drain, the damages,
<br />if any, in making such change to be paid by the grantee.
<br />After the storm drain is constructed in the above described premises, the
<br />grantee agrees to return the surface of the ground to its original elevation.
<br />The rights herein granted may be assigned in whole or in part, and the terms,
<br />conditions and provisions thereof shall extend to and be binding upon the heirs,
<br />executors, administrators, personal representatives, successors and assigns, of the
<br />parties hereto.
