., <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 77-10 <br />PACE 5 <br />the system and using the same after the first day of any <br />quarter shall be charged a per diem prorated amount, based <br />upon the mininnun quarterly charge, from the time such <br />connection is made or such discharge into the system is begun <br />until the comme_nc~nent of the next following billing period. <br />In calculating the annual surcharge based on water consumption <br />for premises connected to the system there shall also be a <br />proration of the annual allowance of water consumption upon <br />which the mi.ninnun quarterly rate for nonresidential users is <br />based and a proration of the actual annual water consumption <br />of such pre2nises. In case of failure to pay any bill for <br />sewer charges when due and payable, a penalty of sixteen (16) <br />percent shall be added to such bill. <br />(b) Any user subject to the charges specified in this chapter <br />shall be entitled to a Five (5) Percent discount for pre- <br />payment of the annual charge, if the same is made within <br />thirty (30) days after the first quarterly billing in <br />February of each year. There is also hereby established a <br />Ten (10) Percent Senior Citizen credit for all single-family <br />residential users who have attained the age of 65 years. <br />Any person wishing to avail him or herself of said credit <br />shall make application to the Director of Public Service <br />between Decgnber 1 and January 15 of each year, and shall make <br />said application on forms provided by the Director of Public <br />Service. However, the Director of Public Service shall provide <br />a reasonable period of time in which said credit can be obtained <br />during the first billing period to be established by this <br />ordinance. <br />(c) The Mayor of the City of North Olmsted is hereby directed to <br />negotiate with and enter into an Agreement with the Regional <br />Income Tax Agency for the purpose of billing users on the <br />basis of the rates established in this Ordinance. Where it <br />is required that meters be read, the Mayor is hereby authorized <br />to take whatever means are necessary to either have meters read <br />by City personnel, or to obtain the records of the City of <br />Cleveland Division of Water for the purpose of determining water <br />consumption. <br />SECTION 3: That Sections 911.03 and 911.05, as previously enacted, <br />be and the same are hereby repealed, and that Sections 911.08, 911.09 and <br />911.10 of the Codified Ordinances of the City of North Olmsted be and the <br />same are hereby repealed. Any other Ordinance or parts of Ordinances in <br />conflict herewith are hereby repealed. <br />SECTION 4: That the rates and procedures established in Sections 1 <br />and 2 hereof shall become effective February 1, 1977. The rates and procedures <br />established by this Ordinance are established in anticipation of .the adoption <br />of a Charter Amendment permitting a three (3) mill levy for debt service <br />relating to the Sewerage Treatment Facilities of the City of North Olmsted; <br />if said Charter Amendment fails to pass the rates and procedures established <br />by this Ordinance are subject to change. <br />SECTION 5: That this Ordinance is hereby declared to be an emergency <br />measure ~mnediately necessary for the preservation of the public health, <br />safety, and welfare and for the further reason that it is immediately <br />
