? , . ? • .`' _.. ? ?""r"? ?; ;. ; . . <br />-2- <br />WHEREAS, as far as it applies to the operation of the Fire <br />Departments of the respective municipal corporations, Section 701.02 of the <br />Ohio Revised Code app7ies to the contracting political subdivisions and to <br />the Fire Department members when they are rendering service outside of their <br />? own subdivisions, pursuant to such agreen;ents. <br />WNEREAS,-each of the aforesaid municipal corporations has authorized <br />the execution of this contract by prbper legislative authority and by proper <br />j legislation by their respective Councils. <br />WHEREAS, it is the intent of the parties hereto that this agreement <br />supercede and realace any prior individual riutual agreements entered into <br />between them. <br />NOW, THEREFORE, the parties hereto, each in consideration of the <br />mutual promises and obligations set forth, agree as follows: ' <br />1. For the purpose of affording additional fire assistance and <br />protection to themselves and their inhabitants, there shall be an interchange <br />I of the services of the Fire Departments, and use of fire personnel and <br />? <br />i equipment, between the parties hereto, and each of said parties will assist <br />? the other party hereto by responding to any call from the Mayor, Director <br />of Public Safety, Chief of Fire or other party to this agreement, with its <br />fire equipment, personnel, and/or other emergency vehicles, and will-render <br />like services while so responding as it renders to itself and its own <br />inhabitants, provided, however, that in no case shall the party hereto called <br />upon or rendering such services be liable in damage to the other party <br />hereto or any of its inhabitants, or contractual obligees, for failure to <br />answer any call, or for lack of speed in answering any such call, or for <br />any inadequacy of equipment, neglic!ent operation of equipment, or for any <br />cause whatsoever growing out of such use of said fire equipment and personnel, <br />nor shall the party fiereto, w hich issued such call. <br /> <br />.
