On any occasion or at any place to which additional assistance <br />is cal7ed under and pursuant to the terms of this agreement, the senior <br />officer or officer in charge of the Fire Department of the calling <br />municipal corporation present shall have full charge and authority over <br />such assisting equipment ard personnel of the responding municipal corpora- <br />I tion. <br />7. Pursuant to Section 717.021 of the Ohio Revised Code, the <br />members of the Fire Department acting outside the 7imits of the municipal <br />corporation in which they are employed, may participate in any pension or <br />? indemnity fund established by their employer to the same extent as while <br />? acting within the employing municipal corporation, and are entitled to all <br />i <br />j the rights and benefits of Sections 4123.01 to 4123.94, inclusive, of the <br />Revised Code of Ohio, to the same extent as while performing service <br />i within the municipal corporation in which they are employed. The pension <br />?I or indemnity fund of the municipal corporation calling for such assistance <br />' shall not be liable for any benefits or,responsible in any way to any <br />( members of the Fire Departments of the responding municipal corporations. <br />8. The parties hereto shall not be required to reimburse or <br />indemnify any pension or indemnity fund of the other party for any pension <br />j or indemnity award or premium contribution assessed against such party <br />lwherein the members of the Fire Department are employed, for workmen's <br />jcompensation benefits and for casualty insurance premiums arising or incurred. <br />! by reason of injuries to or death of a firefighter of such party, as a <br />result of, or occurring vjhile engaged in participation in fire activity or <br />rendering service to such other party under the terms of this agreement, or <br />while going to or from the scene of an activity or service, or while <br />responding to a call pursuant to the terms of this agreement. <br />9. The parties hereby agree that this agreement supercede and <br />replace any prior individual mutual aid agreements entered into between them. <br /> <br />., <br /> <br />
