(3) A fence, hedge, trees or shrubs may be nlaced so as to constitute a fence which is not more than six (6) feet high along any rear or side nronerty line which abuts a General Retail Business District, Limited Industry District or rTixed- Use District. (I) An independent television antenna or radio tower not to exceed fifty (50) feet in height and not tzsed for corrmiercial purposes, so long as it is located in either the rear or side yard, attached to the gabled side of the dwelling. (J) In a Muntiple Residence District, a detached corrunLmity garage providing ro more than the storage space _for two motor vehicles for each dwelling Lmit located on the same 1ot, provided no part of the same is nearer than sixty (60) feet to the street line upon which the multiple dwelling fronts or nearer than forty (40) feet to any other street line, and further provided no repair facilities may be maintained within the same and no repairs except of a minor or emergency nature are made therein.- LL (K) The storagF of one (1) boat or one (1) house trailer which shall not be occupied or used so long as the same are stored in either the rear or side yard. For purposes of this ordinance, however, any area in the front af the dwelling structure shall not be considered side yard. (L) Private swimming pools may be located in a Residential District as an Accessory Use to a dwelling. The pool, accessory buildings, structures or other equipment shall not be located in a front or side yard and shall be not .less than ten (10) feet from any lot line. The swirruning pool area of ground level nools, an area five (5) feet beyond and surrotmding elevated nools, or the entire property on which the pool is located shall be enclosed within a permanent fence of six (6) feet in height to nrevent any access to the pool except from a controlled point. Lighting fixtures shall be designed and located so as not to cast direct rays of excessive brightness upon adjoining residential lots. A com-nact hedge may also be required by the building official to insulate the pool fram adjoining property. However, the fence height provisions of the subsection shall not apply where there is an existing fence at least four (4) feet in height enclosing the entire rear yard provided said fence wa.s constructed prior to October 7, 1975, and was con- structed with a proper building permit. No accessory building may be erected prior to the construction of the dwelling. SECTION 2: That Section 1151.04 as previously adopted and any other ordinance or parts of ordinances in conflict herewith are hereby repealed. SECT?ON 3: That the Clerk of this CoLmcil be and she is herby directed to cause a notice of a Public Hearing hereon to be given pursuant to the nro- visions of Section 14 of Article IV of the Charter of this City.
