<br />? .. <br />1#- <br />CITY OF NORTH OLN1STF.D <br />ORDINANCE N0. 79-81 <br />PAGE 3. <br />(3) A fence, hedge, trees or shrubs may be nlaced so as to <br />constitute a fence which is not more than six (6) feet high <br />along any rear or side nronerty line which abuts a General <br />Retail Business District, Limited Industry District or rTixed- <br />Use District. <br />(I) An independent television antenna or radio tower not to <br />exceed fifty (50) feet in height and not tzsed for corrmiercial <br />purposes, so long as it is located in either the rear or <br />side yard, attached to the gabled side of the dwelling. <br />(J) In a Muntiple Residence District, a detached corrunLmity <br />garage providing ro more than the storage space _for two <br />motor vehicles for each dwelling Lmit located on the same <br />1ot, provided no part of the same is nearer than sixty <br />(60) feet to the street line upon which the multiple dwelling <br />fronts or nearer than forty (40) feet to any other street <br />line, and further provided no repair facilities may be <br />maintained within the same and no repairs except of a minor <br />or emergency nature are made therein.- LL <br />(K) The storagF of one (1) boat or one (1) house trailer which <br />shall not be occupied or used so long as the same are <br />stored in either the rear or side yard. For purposes of <br />this ordinance, however, any area in the front af <br />the dwelling structure shall not be considered side yard. <br />(L) Private swimming pools may be located in a Residential <br />District as an Accessory Use to a dwelling. The pool, <br />accessory buildings, structures or other equipment shall <br />not be located in a front or side yard and shall be not <br />.less than ten (10) feet from any lot line. The swirruning <br />pool area of ground level nools, an area five (5) feet <br />beyond and surrotmding elevated nools, or the entire property <br />on which the pool is located shall be enclosed within a <br />permanent fence of six (6) feet in height to nrevent any <br />access to the pool except from a controlled point. Lighting <br />fixtures shall be designed and located so as not to cast <br />direct rays of excessive brightness upon adjoining residential <br />lots. A com-nact hedge may also be required by the building <br />official to insulate the pool fram adjoining property. <br />However, the fence height provisions of the subsection shall <br />not apply where there is an existing fence at least four (4) <br />feet in height enclosing the entire rear yard provided said <br />fence wa.s constructed prior to October 7, 1975, and was con- <br />structed with a proper building permit. <br />No accessory building may be erected prior to the construction of the <br />dwelling. <br />SECTION 2: That Section 1151.04 as previously adopted and any other <br />ordinance or parts of ordinances in conflict herewith are hereby repealed. <br />SECT?ON 3: That the Clerk of this CoLmcil be and she is herby directed <br />to cause a notice of a Public Hearing hereon to be given pursuant to the nro- <br />visions of Section 14 of Article IV of the Charter of this City.
