SARINGER <br />AN ORDINANCE AMENDING PART SEVEN, "BUSINESS REGULATION CODE", <br />BY ADDING NEW QHAPT'ER 749 CREATING REGULATIONS FOR MASSAGE <br />PARLORS AND OTHER ESTABLISHDlENTS IN T'EE BUSINESS OF OFFERING <br />MASSAGES TO THE NORTH OLMSTED CODIFIED ORDINANCES, AND DE- <br />CLARING AN EMERGENCY. <br />WHEREAS, the Council for the City of North Olmsted has determined that the <br />current North Olmsted Codified Ordinances fail to provide for the regulation of <br />massage parlors and other establishments offering massages, and <br />WEEREA.S, the Colmcil for the City of North Olmsted deems it necessary to <br />provide such regulation for the health, safety and welfare of the citizens of <br />the City of North Olmsted. <br />NOW, TI-EREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMISTED, <br />COiJNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Part Seven (Business Regulation Code) North Olmsted <br />Codifie 0? r-dinance be amended by adding New Chapter 749 as follows: <br />749.01 DEFINITIONS <br />(a) Employee. Any person over eighteen (18) years of age, other <br />than a massagist, who renders any service in connection with the <br />operation of a ma.ssage business and receives compensation from the <br />operator of the business or patrons. <br />(b) Licensee. The person to whom a license has been issued to <br />own or operate a massage establishment as defined herein. <br />(c) Massage. Any method of pressure or friction against or <br />stroking, lmeading, rubbing, tapping, pounding, vibrating, or <br />stimulating of the external parts of the human body with the <br />hands or with the aid of any mechanical electrical apparatus or <br />appliances with or without such supplementary aids as rubbing <br />alcohol, liniments, antiseptics, oils, powder, creams, lotions, <br />ointment or other such similar preparations commonly used in the <br />practice of massage, under such circwnstances that it is reasonably <br />expected that the person to whom the treatment is provided or some <br />third person on his or her behalf will pay money or give any other <br />consideration or any gratuity therefor. <br />(d) Ma.ssage Establishment. Any establishment having a source <br />of income or compensation derived from the practice of ma.ssage as <br />defined in 749.01 (c), and which has a fixed place of business where <br />any person, firm, association, or corporation engages in or carries <br />on any of the activities as defined in 749.01 (c). <br />(e) Massagist, Masseur or ?Ia.sseuse. Any person who, for any <br />consideration whatsoever engages in the practice of massage as <br />defined in 749.01 (c). <br />(f) Outcall Ma.ssage Service. Any business, the function of which <br />is to engage in, or carry on massages at a location designated by the <br />customer or client rather than at a ma.ssage establishment as defined <br />in 749.01 (d). <br />(g) Patron. Any person eighteen (18) years of age who receives <br />a massage under such circLUnstances that it is reasonably expected <br />that he or she will pay money or give any other consideration therefor.
