j CITY OF NORTH OI.?vSTED ORDINANCE N0. 79-71 PAGE 2. (h) Permittee. The person to whom a permit has been issued to act in the capacity of a massagist (ma.sseur or ma.sseuse) as herein defined. (i) Person. Any individua.l, partnership, firm, association, joint stock company, corporation or combination of individuals of whatever form or character. (j) Recognized School. Any school or educational institution licensed to do business as a school or educational institution in the State in which it is located, or any school recognized by or approved or affiliated with the American Massage and Therapy Association, Inc., and which has for its purpose the teaching of the theory, method, profession or work of ma.ssage, which school requires a resident course of study not less than seventy (70) hours before the student shall be furnished with a diploma or certificate of gradua.tion from such school or institution of learning following the successful completion of such course of study or learning. (k) Sexual or Genital Area. Genitals, pubic hair, buttocks, anus, or perinetun of any person, or the vulva or breasts of a female. 749.02 PERMIT REQUIRED (a) Business License Required. No person'shall engage in or carry out the business of ma.ssage unless he has a valid massage business license issued by the State of Ohio pursuant to the pro- visions of the Ohio Revised Code. (b) Massagist's Permit Required. No person shall practice massage as a massagist, employee or otherwise, unless he has a valid and subsisting massagist's permit or license issued to him by the State of Ohio pursuant to the provisions of the Ohio Revised Code. 749.03 EXENIPTIONS This Ordinance shall not apply to the following individuals while engaged in the personal performa.nce of the duties of their respective professions: (a) Physicians, surgeons, chiropractors, osteopaths, or physical therapists who are duly licensed to practice their respective professions in the Sate of Ohio. (b) Nurses who are registered under the laws of the State of Ohio. (c) Barbers and beauticians who are duly licensed under the laws of the State of Ohio, except that this exemption shall apply solely to the ma.ssaging of the neck, face, scalp and hair of the customer or client for cosmetic or beautifying purposes. 749.04 APPLICATION FOR MASSAGE ESTABLISH^IENT LICENSE Every applicant for a license to maintain, operate, or conduct a massage establishment shall file an application under oath with the City of North Olmsted upon a form provided by the Department of Public Safety and pay a nonrefundable annual license fee, which shall be $100.00 per year or any part thereof. The application once accepted shall be referred to the Department of Public Safety for investigation. Copies of the application shall within five (5) days also be referred to the Building Department and the Fire Department. The departments shall within thirty (30) days inspect the premises proposed to be operated as a ma.ssage establishment and sha.ll make written verification to the Department of Public Safety concerning compliance with the codes of the City of North Olmsted and State of Ohio that they administer.
