? <br />. ; <br />BY:?? 1 <br />? <br />CITY OF NORTH OLNLSTED <br />ORDINANCE N0. 79- 18 <br />AN ORDINANCE ArENDING SECTION 3 OF ORDINANCE 78-15 ENTITLF,D <br />"AN ORDINANCE ESTABLISHING COMPENSATION TO BE PAID TO THE <br />DIPLOYEES OF THE NORTH OLMSTED T.'l[JNICIPAL BUS LINE, AND DECLARING <br />AN II=,GENCY", AND DECLARING AN EMERGFNCY. <br />NOW, TEEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OI,TJISTED, COUNT'Y OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Section 3 of Ordinance 78-15 enacted February 7, 1978, <br />which now rea s as follows: <br />"SECTION 3: Work tiVeek - Overtime <br />A. The normal work week for regular full time employees of the North <br />Olmsted Municipal Bus Line shall be forty (40) hours. Said work week shall <br />commence at 12:01 A.M. Sunday through 12:00 Midnight Saturday. It is recognized <br />that the bus line shall be maintained on a schedule compatible with efficient <br />and practical transit service seven (7) days a week. Therefore, it is further <br />recognized that the North Olmsted Municipal Bus Line retains the right to manage <br />and direct the work force as well as the right to determine the manner and <br />method of assigning work. It is further recognized that some employees may be <br />assigned to work schedules to accommodate seven (7) day per week service which <br />may of necessity involve overtime work. Hourly employees will be paid at time <br />and one-half of the straight time rate for all hours in excess of eight (8) <br />hours per day, and also, time and one-half of their straight time rate for all <br />hours worked in excess of forty (40) hours in any one work week. However, under <br />no circwnstances shall there be a pyramiding of overtime. It should also be <br />noted that the North Olmsted A'Iunicipal Bus Line shall determine the manner and <br />method of assigning and offering all overtime work which is consistent with <br />efficient transit practices. <br />B. When a bus driver is assigned work on his scheduled day off it is <br />wlderstood that time will be paid at the ti.me and one-half rate with the <br />exception of charter work. The time worked in charter service will be paid <br />on a straight time rate and will not be used in computing overtime pay. <br />C. U7ith respect to non-bus driving personnel, in the comnutation of <br />taeekly overtime, recognized holidays shall be considered as time worked to the <br />extent of the normal regular hours called for, except where the holiday coincides <br />with the scheduled day off of the employee. <br />D. All salaried employees may be paid overtime upon recormnendation of <br />department heads and approval of the appointing authority, at the time and one- <br />half hourly rate, provided, however, that in no such instance shall daily and <br />weekly overtime be duplicated. <br />All such salaried employees who work in excess of the applicable <br />and appropriate basic work week hours shall be paid for such excess time worked <br />at his or her time and one-half hourly rate in addition to his or her salary, <br />provided that such overtime is authorized by the emnloyee's supervisor. <br />In the comnutation of weekly overtime, recognized holidays shall <br />be considered as time worked to the extent of the normal regular hours called <br />for, except where the holiday coincides with the scheduled day off of the employee. <br />E. There is hereby established a work training program within the <br />Municipal Bus Line. Said training period shall not exceed thirty (30) days <br />and any driver who is included within said training progxam shall be paid at the <br />rate of $21.20 per day." <br />be and the same is hereby amended and as amended shall read as follows:
