. <br />w ?:.. .?,. <br />? <br />CITY OF NORTH OLhISTED <br />ORDINANCE N0. 79-18 <br />PAGE 2. <br />SECTION 3: Work Week - Overtime <br />A. The normal work week for regular full time employees of the North <br />Olmsted Nhunicipal Bus Line shall be forty (40) hours. Said work week shall <br />comQnence at 12:01 A.M. Swlday through 12:00 Midnight Saturday. It is recognized <br />that the bus line shall be maintained on a schedule compatible with efficient <br />and practical transit service seven (7) days a week. T'herefore, it is further <br />recognized that the North Olmsted MLmicipal Bus Line retains the right to manage <br />and direct the work force as well as the right to determine the manner and <br />method of assigning work. It is further recognized that some employees may be <br />assigned to work schedules to accommodate seven (7) day per week service which <br />may of necessity involve overtime work. Hoursly employees will be paid at time <br />and one-half of the straight time rate for all hours in excess of eight (8) <br />hours per day, and also, ti.me and one-half of their straight time rate for all <br />hours worked in excess of forty (40) hours in any one work week. However, under <br />no circwnstances shall there be a pyramiding of overtime. It should also be <br />noted that the North Olmsted Municipal Bus Line shall determine the manner and <br />method of a.ssigriing and o.fferirig-All-overtime"work which is consistent with <br />efficient transit practices.• - - <br />B. When a bus driver is assigned work on his scheduled day off it is <br />understood that time will be paid at the time and one-half rate with the <br />exception of charter work. The time worked in charter service will be paid <br />on a straight time rate and will not be used in computing overtime pay. <br />C. With respect to non-bus driving personnel, in the computation o£ <br />weekly overtime, recognized holidays shall be considered as time worked to the <br />extent of the normal regular hours called for, except where the holiday coincides <br />with the scheduled day off of the employee. <br />D. Al1 salaried employees may be paid overtime upon recommendation of <br />department heads and approval of the appointing authority, at the time and one- <br />half hourly rate, provided, however, tha.t in no such instance shall daily and <br />weekly overtime be duplicated. <br />All such salaried employees who work in excess of the applicable <br />and appronriate basic work week hours shall be paid for such excess time worked <br />at his or her time and one-half hourly rate in addition to his or her salary, <br />provided that such overtime is authorized by the employee's supervisor. <br />In the computation of weekly overtime, recognized holidays shall <br />be considered as time worked to the extent of the normal regular hours called <br />for, except where the holiday coincides with the scheduled day off of the employee. <br />E. There is hereby established a work training program within the <br />Ntunicipal Bus Line. Said training period shall not exceed thirty (30) days <br />and any driver who is included within said training program shall be paid at the <br />rate of $23.20 per day. <br />SECTION 2: That Section 3 0£ Ordinance 78-15 enacted February 7, 1978, <br />is hereby repealec and any other ordinances or resolutions or parts of ordinances <br />or resolutions in conflict herewith be and the same are hereby repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />measure irmne lately necessary for the preservation of the public health, safety, <br />and welfare, and for the further reason that it is irmnediately necessary to <br />establish the salaries and benefits for North Olmsted Municipal Bus Line <br />emnloyees to coincide with increases granted by the Regional Transit Authority <br />effective February 1, 1979, and further provided it receives the affirmative vote <br />of two-thirds of all members elected to Cotmcil, it shall take effect and be in <br />force immediately upon its passage and approval by the r9ayor.
