DELLA VELLA <br />BUILDING COMPANY FOR STORM SEWERS LOCATED IN THE TIMBER <br />TRAIL SUBDIVISION WITHIN TffE CITY OF NORTH OLNIST'ED. <br />WHEREAS, a storm sewer has been incorporated within the design and <br />construction of the Timber Trail Subdivision, and <br />WHEREAS, the City Engineer has advised the Council that it is in the <br />best interest of the City of North Olmsted to accept an easement with respect <br />to the storm drainage system, and <br />Wf-IEREAS, it is the desire of the City of North Olmsted and said M. Della <br />Vella Building Company to have the City's rights in said storm drainage system <br />clearly specified and made a matter of record by recording a formal easement, <br />and <br />WHEREAS, this Council deems it to be in the best interest of the City <br />of North Olmsted to accept said Easement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COtJNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept an easement from <br />M. Della Vella Building Company for the construction and maintenance of a storm <br />drainage system under and on the property described in said Easement which is <br />attached hereto and marked Exhibit "A", and made a part hereof as though fully <br />rewritten herein. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby <br />directe to cause said Ea.sement to be recorded in the Office of the Recorder <br />of Cuyahoga County. <br />SECTION 3: That this Ordinance shall take effect and be in force from <br />and after the earliest period allowed by law. <br />PASSED: <br />ATTEST: <br />&?V? t 2 <br />F ORENCE CAMPBELL, CL OF COUNCTL <br /> <br /> <br />First reading: /-e2 - 79 <br />Second reading : /- /,/ - 7p <br />Third reading: ?2 _ d - -7 2 <br />? <br />.
