-2- <br />of the agreeing subdivision. <br />WHEREAS, as far as it applies to the operation of the Fire Depart- <br />ments of the respective municipal corporations, Section 701.02 of the <br />Ohio Revised Code applies to the contracting political subdivisions <br />and to the Fire Department members when they are rendering service <br />outside of their own subdivisions, pursuant to such agreements. <br />WHEREAS, each of the aforesaid municipal corporations has <br />authorized the execution of this contract by proper legislative <br />authority and by proper legislation by their respective Councils. <br />NOW, THEREFORE, the parties hereto, each in consideration of the <br />mutual promised and obligations set forth, agree as follows: <br />1. For the purpose of affording additional fire assistance and <br />protection to themselves and their inhabitants, there shall be an <br />interchange of the services of the Fire Departments, and use of fire <br />personnel and equipment, between the parties hereto, and each of said <br />parties will assist the other party hereto bg responding to any call <br />from the Mayor, Director of Public Safety, Chief of Fire or other <br />party ~o this agreement, with its fire equipment, personnel, and/or <br />other emergency vehicles, and will render like services while so <br />responding as it renders to itself and its own inhabitants, provided, <br />however, that in no case shall the party hereto called upon or <br />rendering such service be liable in damage to the other party hereto <br />or any of its inhabitants, or contractual obligees, for failure to <br />answer any call, or for lack of speed in answering any such call, or <br />for any inadequacy of equipment, negligent operation of equipment, <br />or for any cause whatsoever growing out of such use of said fire <br />equipment and personnel, nor shall the party hereto, which issued <br />such call. <br />
