CITY OF NORTH OLMSTED <br />ORDINANCE N0. 74 - ~i?/ <br />e: <br />AN ORDINANCE TO APPROVE, ADOPT AND <br />ENACT PART FIVE - GENERAL OFFENSES <br />CODE - OF THE CODIFIED ORDINANCES; <br />TO REPEAL ORDINANCES IN CONFLICT <br />THEREWITH, TO PUBLISH THE ENACTMENT <br />OF NEW MATTER, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Council of the City of North Olmsted has had the <br />matter of recodification and general revision of the General Offenses <br />Code before it for some time, and <br />WHEREAS, it has heretofore entered into a contract with Walter H. <br />Drane Co. to prepare and publish such codification, and <br />WHEREAS, the recodification of said Code together with new material <br />to be adopted, the matters to be amended, and those to be repealed, <br />are before the Council; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the former Part Five (General Offenses) of the <br />Codi ie Ordinances and other ordinances of the City of North Olmsted, <br />Ohio, of a general and permanent nature, as revised, recodified, re- <br />arranged and consolidated into a component code, titles, chapters and <br />sections are hereby approved, adopted, and enacted as the new Part <br />Five (General Offenses) of the Codified Ordinances of the City of <br />North Olmsted. <br />One book-form copy of Part Five (General Offenses) as revised and <br />recodified, shall be certified as correct by the Mayor and the Clerk <br />of Council, attached to this ordinance as a part hereof, and filed <br />with the permanent ordinance records of the City of North Olmsted. <br />SECTION 2: All provisions of Part Five (General Offenses) of the <br />Codified Ordinances shall be in full force and effect from and <br />immediately after passage of this ordinance and approval by the Mayor. <br />All ordinances and resolutions or parts thereof which are inconsistent <br />with any provision of Part Five (General Offenses) of the Codified <br />Ordinances are hereby repealed as of the effective date of this ordi- <br />nance, except that the enactment of Part Five (General Offenses) of <br />the Codified Ordinances shall not be construed to affect a right or <br />liability accrued or incurred under any legislative provision prior <br />to the effective date of such enactment, or an action or proceeding <br />for the enforcement of such right or liability. Such enactment <br />shall not be construed to relieve any person from punishment for an <br />act committed in violation of any such legislative provision, nor to <br />affect an indictment or prosecution therefor. For such purposes, <br />any such legislative provision shall continue in full force notwith- <br />standing its repeal for the purpose of revision and recodification. <br />SECTION 3: Any section or subsection of Part Five (General <br />Offenses o~the Codified Ordinances without a legislative history <br />or with the words "Adopting Ordinance" at the end thereof is new <br />matter ordained by this Adopting Ordinance. <br />SECTION 4: Pursuant to Article IV, Section 11 of the City Charter, <br />the Clerk of Council shall.post a copy of this ordinance together with <br />a copy of Part Five (General Offenses) of the Codified Ordinances <br />for a period of not less than fifteen days at the City Hall. <br />
