W~ ~ r R CITY OF NORTH OLMSTED ORDINANCE N0. 74 -~~ BY: John Goggin AN ORDINANCE AMENDING THE CODIFIED ORDI- NANCES OF THE CITY OF NORTH OLMSTED BY CREATING A NEW CHAPTER 519 ENTITLED "TREES AND WEEDS" AND DECLARING AN EMERGENCY. WHEREAS, it is the desire of the Administration and Council to provide regulations for the removal of weeds and trees from lands within the City, and WHEREAS, it is the belief of the Administration and Council that this can best be accomplished by creating a new chapter within the Codified Ordinances setting out regulations for the control of weeds and trees; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Codified Ordinances of the City of North Olmsted a and are hereby amended by creating a new Chapter 519 en- titled "Trees and Weeds", which said chapter shall read as follows: CHAPTER 519 TREES AND WEEDS 519.01 Removal of Trees, Weeds and Grass No owner, occupant or person having the charge or management of any lot or parcel of land situated within the City whether improved or unimproved, vacant or occupied, shall permit any noxious or poisonous weeds or vines to exceed a height of twelve (12) inches, nor shall any such person permit any tree, plant, grass or shrubbery or part thereof to grow in an unsightly or untrimmed condition. 519.02 Notice (a) At any time the conditions specified in Section 519.01 hereof-exist the City shall serve upon the owner, occupant, or person having charge, notice that within Five (5) days, the condition should be abated. Said notice shall be by registered mail and in conformity with Ohio Revised Code Section 731.52. (b) In addition to the provisions with respect to notice in part (a) hereof, the City shall notify the person, occupant, or person having charge or management of any lot or parcel of land, by regular mail, on or before May 1st of each year, informing said party that the City will conduct regular inspections of each lot or parcel of land within the City, bi-monthly, and will cause the trimming or removal of any tree, plant, shrubbery, or grass and weeds, as the need for said trimming and removal arises, and shall charge the owners the cost of removal and trimming as determined by the Director of Public Service. 519.03 Enforcement' by Service Director; Work by City. In the event the owner does not trim or remove any tree, plant or shrubbery, or any part thereof, or any weeds, in accordance with the provisions of this Chapter, the Director of Public Service is hereby authorized and it shall be his duty to enforce the provisions of this chapter, to cause such tree, plant or shrubbery, or part thereof, to be trimmed or removed, and to cut and remove all weeds.
