<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 74 - 48 <br />BY : i~~ <br />AN ORDINANCE AMENDING THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED <br />BY CREATING A NEW CHAPTER 735 ENTITLED <br />"MAINTENANCE OF UNOCCUPIED COMMERCIAL <br />BUILDINGS", AS AMENDED. <br />WHEREAS, the Council of the City of North Olmsted deems it in <br />the best interest of residents of the City to make the City as free <br />as possible from hazards created by commercial buildings which are <br />no longer occupied, and <br />WHEREAS, this Council believes that this can be accomplished <br />by adopting regulations contn~lling the maintenance and upkeep of <br />buildings and grounds of unoccupied commercial and business areas; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Codified Ordinances of the City of North <br />Olmsted be and the same are hereby amended by creating a new Chapter <br />735 entitled "Maintenance of Unoccupied Commercial Buildings" which <br />shall read as follows: <br />CHAPTER 735 <br />MAINTENANCE OF UNOCCUPIED COMMERCIAL BUILDINGS <br />735.01 Definitions <br />For the purposes of this Chapter, the following words and terms <br />shall have the meanings ascribed to them in this section: <br />a. Unoccupied Commercial Buildina. Any building or buildings <br />including the land on which they are situated which is used or <br />intended to be used for the retail, commercial or business <br />occupancy within which commercial transactions have ceased and <br />been abandoned for a period in excess of thirty (30) days. <br />b. Refuse. (See also Garbage) All putrescible and non-putrescible <br />solid wastes (except body wastes) including but not limited to: <br />garbage, rubbish, ashes, street cleaning, dead animals and <br />solid market and industrial wastes. <br />c. Garbage. (See also Refuse) Putrescible, animal and vegetable <br />waste resulting from the handling, preparation, cooking and <br />consumption of food. <br />d. Natural Growth. Dead trees and limbs or other natural growth <br />which, by reason of rotting or deteriorating conditions or <br />storm damage, constitute a hazard to persons in the vicinity <br />thereof. <br />e. Exterior of the Premises. Those portions of a building which are <br />exposed to public view and the open space of any premises outside <br />of any building erected thereon. <br />
