<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - 48 <br />Page 2 <br />f. Owner. "Owner" is the owner or owners of the premises including <br />the holder of title thereto subject to contract or purchase, <br />trustee, a vendee in possession, a mortgagee or receiver in <br />possession, a lessee or joint lessees of the whole thereof, <br />or tenant, or an agent or any other person, firm, corporation <br />or fiduciary directly in control of the premises. <br />735.02 Purpose <br />The purpose of this Chapter is to establish minimum standards for <br />the maintenance of land and buildings used for commercial purposes <br />which have ceased business for a period of thirty (30) days or more. <br />735.03 General Maintenance <br />Any premises on which there is a building situated which is used <br />for commercial or business purposes and the commercial or business <br />functions cease and the building and premises become unoccupied <br />for a period of in excess of thirty (30) days, the owner shall keep <br />and maintain the premises and structures thereon free of all nuisances <br />and any hazards to the safety of pedestrians and other persons. The <br />premises shall be kept free of refuse, garbage and natural growth, <br />all of which shall be promptly removed and abated by the owner. It <br />shall .also be the responsibility of the owner to keep the premises <br />free of all hazards which include but are not limited to accumula- <br />tions of refuse, garbage and natural growth. <br />735.04 The Boarding of Structures <br />In the event the owner of any unoccupied commercial structure deems <br />it necessary to cover the windows, doors and/or other means of ingress <br />to the building, the material used to accomplish that purpose shall <br />have the exterior portion thereof coated with a protective coating <br />to prevent rot and decay. <br />735.05 Sign Removal for Unoccupied Commercial Buildincts <br />a. The owner of any signs, or the owner of the premises on which <br />they are located shall be responsible for the removal of such <br />signs if and when the business is abandoned. Such removal shall <br />include the complete blocking out of all painted wall signs and <br />supports, braces, guys, anchors, and electrical service. The <br />removal of these signs shall be carried out within thirty (30) <br />days after the time specified in Section 735.03 hereof. <br />b. In the case of non-compliance with the above provisions, the <br />Building Commissioner shall notify in writing the owner of the <br />abandoned signs and the owner of the premises on which such <br />signs are located, or have the option that such notice may be <br />given to either one of them ordering the removal of such signs. <br />If this order is not complied with within fourteen (14) days <br />after the date of such order, the Building Commissioner shall <br />remove such signs at the expense of the owner of the real estate. <br />l <br />
