A <br />~, ~ 2.. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. ~%„~, !p <br />BY : J~/ <br />AN 0 INANCE CREATING A NEW CHAPTER 743 ENTITLED <br />"REGULATION OF HOURS OF DELIVERIES TO COMMERCIAL <br />ESTABLISHMENTS" OF PART 7 OF THE BUSINESS <br />REGULATION CODE OF THE CITY OF NORTH OLMSTED AS AMENDED. <br />WHEREAS, this Council and Administration deems it in the <br />best interest of the citizens of North Olmsted to regulate <br />the hours of deliveries to commercial establishments when <br />said commercial establishments are in close proximity to <br />residential structures. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That there is hereby created a new Chapter 743 <br />entitled "Regulation of Hours of Deliveries to Commercial <br />Establishments" of Part 7 of the Business Regulation Code of <br />the City of North Olmsted which shall read as follows: <br />Chapter 743 - Regulation of Hours of Deliveries to <br />Commercial Establishments <br />743.01 Purpose <br />The purpose of this Chapter is to protect the health, safety <br />and welfare of the citizens residing in residential areas who <br />live adjacent to or contiguous to commercial establishments <br />where delivery of goods are carried on at all hours of the day <br />and night. It is not the purpose of this Chapter to prevent <br />all deliveries, but simply to regulate times when deliveries <br />may be made, recognizing and balancing the necessity of the <br />delivery of goods to commercial establishments and the rights <br />of the citizens of North Olmsted to lead lives free from noise <br />and clamor at hours which are normally used for sleep. <br />743.02 Definitions <br />(A) Commercial establishment means any business, store, <br />warehouse, or other mercantile building carrying on a business for <br />profit where commodities are received, exchanged, bought, or sold. <br />(B) Residential Building, for the purposes of this Chapter, <br />means any building or structure used as a dwelling or abode located <br />within a residential zoning district as defined by the Zoning Code <br />of the City of North Olmsted. <br />(C) Person, for the purposes of this Chapter, .besides being <br />a natural person, means a person, which also includes any agent, <br />superintendent, officer or partner who alone or with .others <br />have charge, care, or control of deliveries or acceptance of <br />delivery of goods or merchandise. <br />yr::.... . ~. .. .. ro,~.,w <br />
