G ,,~ <br />~ r 4 <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 75 - ~/` <br />Page 2 <br />743.03 Prohibitions <br />No person shall deliver or cause to be delivered, <br />accept delivery of any goods or merchandise to or at a <br />establishment within two hundred fifty (250) feet of a <br />residential building between the hours of 12:00 midnight <br />6:00 am. <br />743.04 Measurement <br />or <br />commercial <br />and <br />For the purposes of this Chapter, the measurement referred <br />to in Section 743.03 hereof shall be determined as follows: <br />any measurement by a direct line from the nearest point of the <br />residential building to the nearest part of any loading dock <br />or other place .where goods are received, dispersed, or <br />delivered to the commercial establishment. <br />743.05 Penalties <br />Tahoever violates any provisions of this Chapter shall be <br />deemed guilty of a minor misdemeanor and shall be fined not more <br />than One hundred dollars ($100.00) for each violation committed <br />hereunder. <br />743.06 Other Legal Action <br />In addition to the penalties provided in Section 743.05 <br />of this Chapter, nothing shall preclude the institution of <br />appropriate legal proceedings in a Court of proper jurisdiction <br />by the Department of Law for the purpose of abating violations of <br />this Chapter. <br />SECTION 2: That this ordinance shall take effect and be <br />in force from and after the earliest period allowed by law. <br />Passed: P .~ + <br />Attest: G~/ <br />Nora T.
