<br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO . 7 5 - ~ 9~ <br />Page 3. <br />SECTION 8: Water Accumulation. <br />That no condition shall be created nor any existing condition maintained. <br />whereby there will be upon any lot or plot excavations, depressions, <br />pits, holes, gullies, or similar depressions which may accumulate and <br />retain surface water and.. which may become a public hazard or nuisance. <br />SECTION 9: Topographic Map Required. <br />That no building permit shall be issued until the topographic map for <br />the subdivision or similar plan for the parcel has been approved. by <br />the City Engineer. <br />SECTION 10: Grades on Dedicated Streets within the City of <br />North Olmsted. <br />That on a dedicated street within the City of North Olmsted no person, <br />firm, or corporation shall be issued a building permit for the con- <br />struction of any structure until a $500.00 cash deposit is paid to <br />the Building Commissioner to cover administrative costs, cost of checking <br />grades and drainage of surface water. The balance of said, cash deposit <br />shall be refunded upon compliance with the terms of this ordinance <br />after deducting therefrom any costs and expenses incurred by the City <br />as a result of work done by the City Engineer. <br />In cases involving commercial or multi-family property., the City may <br />require a deposit greater than the $500.00 to guarantee such compliance. <br />The amount thereof shall be determined by the City Engineer, which <br />determination shall be based upon the estimated cost of performing <br />such drainage work. <br />If the aforesaid work is not done within thirty (30) days from the time <br />of the sending of~written notice by the City of North Olmsted, the <br />City may do the work and the aforesaid cash deposit shall be applied <br />to the cost of the City doing the aforesaid grading and any funds which <br />are in excess of the City's cost of grading shall be returned to the <br />person making the deposit as aforesaid, and further, any deficiency <br />in funds between the deposit and the cost of the City doing the grading, <br />shall become a lien upon the lands and shall be certified to the <br />Auditor of the County of Cuyahoga for entering upon the tax duplicate <br />and collection as other taxes and. shall be returned by the Auditor of <br />Cuyahoga County to the City for deposit in the General Fund of the City <br />of North Olmsted. <br />SECTION 11: Grades Where no Grade Plan Provided. <br />V~Then the City Engineer is not provided a grade plan for approval, the <br />City Engineer shall be charged with-the duty of checking all natural <br />and finished grade lines of all lots, plots, or lands located within the <br />municipal boundaries of the City of North Olmsted and shall establish <br />grade lines for all streets, sidewalks, sanitary and storm sewers and <br />structures of every kind and description. <br />
