~- <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 75 - 195 <br />Page 4. <br />SECTION 12: Maintaining Grade Lines Established by the City. <br />That when the City Engineer has set and finally determined and esta- <br />blished the finished grade line of any parcel of real estate, lot, or <br />land within the City of North Olmsted, Ohio, thus providing for the <br />drainage of surface water therefrom, the owner, occupant, or any other <br />person in charge of said premises shall continue to maintain and adhere <br />to said finished grade line of said premises and shall further keep <br />all drains, ditches, swales, or other surface water conductors open <br />and free and clear of any and all obstructions. <br />Any Builder, Contractor, Landscaper, or Owner doing any grading, <br />regrading, landscaping, sodding, or performing any other work affecting <br />drainage of any parcel of land in the City of North Olmsted., Ohio, shall, <br />prior to doing any such work, obtain from the City Engineer a permit to <br />perform such work. Such person or persons shall furnish a plan of the <br />parcel of land upon which the work is to be performed. The plan shall <br />show all data necessary to determine the extent and character of the <br />work to be done and its effect upon drainage. As a condition for <br />issuance of a permit for grading, regrading, landscaping, sodding, and <br />other such work, the person or persons performing such work shall <br />deposit with the City Engineer the sum of $50.00. <br />a. This deposit shall be used for checking of plans, <br />establishing finished grades where necessary and <br />inspection and/or surveys. Costs shall be calcu- <br />lated at $20.00 per hour for the City Engineer or <br />his field crew (survey) and, $7.50 per hour for <br />inspection. <br />b. If work does not conform to the approved plans and <br />the deficiencies are not corrected within 15 days <br />after requested by City Engineer, then the City <br />Engineer shall cause the deficiencies to be corrected <br />as provided under Sections 14 and 16. When the work <br />has been completed, inspected, and approved. by the City <br />Engineer, whatever balance remaining in the deposit <br />may be refunded. <br />SECTION 13: Failure to Comply. <br />That, in the event the owner, occupant, or any other person in <br />charge of said premises fails to comply with the requirements of this <br />ordinance, then the City of North Olmsted may enter upon said premises <br />and remove any and all obstructions from any drains, ditches, swales, <br />or other surface water conductors, and regrade the surface of said <br />premises to the finished. grade line heretofore established. <br />SECTION 14: Notice to Comply and City Charges for Work Performed. <br />In the event said City deems it necessary to enter said premises to <br />perform the work described in Section 13 of this ordinance, then the <br />City shall first give written notice by certified mail to said owner, <br />occupant, or other person in charge of said. premises, or by posting <br />
