,» ~, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 75 - ~ ~~ <br />Page 5. <br />a copy of said notice on the premises to comply with the requirements <br />of this ordinance within the time specified in said notice. In case <br />of the failure or refusal of such owner, occupant, or other person in <br />charge of said premises to comply with said notice and the requirements <br />of this ordinance, then the work required thereby may be done at the <br />expense of the City. The City then shall determine the amount paid for <br />said work and shall ascertain the description of the .property on which <br />work was done. Such amount paid for said work and the description of <br />said property shall be certified to the Auditor and shall be entered <br />upon the tax duplicate, become a lien upon such lands from the date of <br />entry, and shall be collected as other taxes and returned to the City <br />for deposit in the General Fund. In the alternative, the City may <br />recover the amount of money so expended for said work from the owner, <br />occupant, or other person in charge of said premises, before any court <br />of competent jurisdiction. <br />SECTION 15: Private Storm Water Drainage Systems. <br />Catch basins located on private property and designed to handle sur- <br />face water shall be considered an integral part of the drainage system, <br />and all the provisions of the Drainage Ordinances shall apply to these <br />catch basins and the pipes which connect them to the storm sewers. <br />On single-family residential lots these catch basins shall consist <br />of 12-inch by 4-inch wyes or tees, and their connecting. pipe shall <br />meet one of the following specifications: PVC pipe conforming to <br />ASTM D3033, D3034, or D2729; C-200 vitrified pipe; other rigid <br />pipe for which written approval has been obtained from the City <br />Engineer. <br />All catch basins on single-family residential lots shall be designed <br />to handle flow rates of 60-gallons per minute, or greater, with the <br />water level below the rim of the basin. At the City's option, these <br />catch basins may be tested. for flow capacity; basins which do not <br />handle the required flow rate shall be repaired by the builder. <br />SECTION 16: Penalty. <br />That any person, firm, or corporation violating any of the provisions <br />of this ordinance shall be deemed guilty of a misdemeanor, and upon <br />conviction thereof, fined not more than $250.00. Each day of violation <br />shall constitute a separate offense. <br />SECTION 17: That Ordinance No. 74-166 and any other ordinances <br />or parts of ordinances in conflict herewith are hereby repealed.. <br />SECTION l8: That this ordinance shall take effect and be in <br />force from and aft~e`r the earliest period allowed. by law. <br />PASSED • lc.~_ .!' <br />ATTEST: <br />~~~~ <br />NORA T.
