~' <br />be and remain the employees of the City and shall not be em- <br />ployees of the Authority. The City shall not increase the <br />present number of supervisory or managerial personnel nor <br />make any significant changes in its transit management <br />structure without first obtaining the written approval of <br />the Authority, which approval shall not be unreasonably <br />withheld. <br />4. Labor Relations. The City shall keep the Au- <br />thority currently advised of all labor disputes, all nego- <br />tiations, and the progress of all negotiations with its <br />Transit Personnel concerning wage rates, fringe benefits, <br />pensions or other retirement benefits, and working condi- <br />tions. The City shall not grant or provide to its Transit <br />Personnel any wage rates, fringe benefits, pensions or other <br />retirement benefits or working conditions any of which would <br />exceed the rates, benefits and conditions, respectively, <br />then available to the Authority`s Transit Personnel, e~:cept <br />that the City may continue in effect such rates, benefits <br />and conditions as are currently being paid or provided for <br />its Transit Personnel. <br />S. Funds. The City shall maintain current pay- <br />ments for all fringe benefits, pension plans or retirement <br />benefits,. PERS, Workmen's Compensation, health plans, or <br />other programs required by agreement with its Transit Per- <br />sonnet and by state, federal or municipal 1<~w, and as re- <br />quired to keep such plans and programs actuarially sound. <br />The City hereby represents that there are no deficiencies <br />presently owed by it with respect to any such funds or <br />programs. <br />6.
