'~ MINUTES OF THE MEETING OF THE COUNCIL CF <br />TIIE CITY OF NORTH OLMSTF,D, OTiIC <br />DECEMBER 15, 1959 - 8:10 P.M, <br />Present were Paul J. Gareau, Mayor; Ralph A. Hazelton, President of Council; <br />Ralph E. Christman, Evelyn Hinkel, Eddie Hixson, Wm. H. Kramer, Mary Alice <br />Lynch, Bruce MacDonald, and Francis J. O'Neill. <br />Also present were Lloyd E. Barnes, Service Director; James T. ~~rilson, <br />Safety Director; C. J. Oviatt, Solicitor; Alex Ifanareff, Engineer; and <br />E. M. Christman, Clerk. <br />Absent: Alice Dobbins Rhine. <br />The minutes of the rf:gular meeting of the Council December 1st were read. <br />and approved as corrected. <br />The minutes of the adjourned meetings of the Council December 4th, and <br />December 7th, were approved as read. <br />The Mayor reported he had received a commun-+_cation from the City of Cleveland <br />Department of Law, designating X82,47 as the amount to be paid by the City <br />of North Olmsted as its porti..on toward opposing the East Ohio Gas rate <br />increase. The costs average cut to .61¢ per person, shared on a per capita <br />basis by all the cmmmunities in Cuyahoga County serviced by the East Ohio <br />Gas, in addition to those outside of the County which cooperated in this <br />matter. Total expenses for the services of James TAI. Honaker, Dr, Thomas <br />Walsh, plli5 telephone and telegraph expenses amounted to $11,426.37. The <br />result was that the suit for increase in c'rrarges to non-industrial customers <br />was reduced from 22,4 million dollars to 9.7 million dollars per year. <br />~_ communication was also received from the Opa-Locker Civic Improvement League, <br />Opa-Locker, Florida, in regards to House Bill No, 9233 to amend t're Internal <br />Revenue Code of 1954 to allow a. taxpayer to deduct for income tax purposes <br />certain special assessments and other char,~es made against him or his <br />property under local law without regard to whether they tend to inere~.se <br />the value of such property, Passage of this ~•~~uld enable a taxpayer to <br />claim as dedT~.ctioxrs payments made to local Go~~ernments for services or <br />public improvements when such payments are made in the form of service <br />cr~a.rges or assessments. They also urge endorsement of such legislation <br />by our Council by passim; a resolution and forwarding same to our representa- <br />tive in Congress and Senators. They also request that we notify them of the <br />action ta'~en, The matter was referred to the Ti~rance Committee for study <br />and recommendation. <br />The Mayor also reported relative to the hearing before the Board of Tax <br />Appeals in defense of the County Budget Commission Grant. mhe City presented <br />its case, ar~d the court was satisfied with the testimony of the witnesses, <br />Special Counsel cited a law rendered by the Chief Justice whereby Municipali- <br />ties or Political Communities having failed to file with the Budget Commissio: <br />the Commission cou~d refuse to set a tax rate, w`iich resulted in the with- <br />drawal of several appelants. Uur brief wii_l be fil~,d on February 5th, and <br />a decision is expected orr the 15th of February, 1960. <br />The Service Director presented a resolu+.ion prepared by the County Engineer's <br />Gffice for the maintenance and repair of County roads within the City of <br />Tdorth Ol,bsted. <br />The Service Director also advised the Sewer Committee is to review the <br />changes made in the specifications for the Sewert~ge Treatment Plant. They <br />are minor construction matters perta~_ning to the sign on the Treatment <br />Plant, the size and wording, a:~d the sludge pump, which was sent out as an <br />addendum without advance notice to the City. <br />The Service Director also recommended Council's action wit'r. regards to the <br />$30,000.00 for the construction of the addition to the Police Station for <br />jail cells. The Sepper C<~rporation submitted the lowest bid for General <br />Contracting at $21,955.00; Duisik Plumbing and Heating Company submitted <br />the lowest bid for Plumbing at X3,825.00; and California Electric Constructi.c <br />submitted the lowest b~_d for electrical work at ~1,2gg.oo, <br />
