<br />Mr. Wilson stated that in view of the Solicitors remarks at last Council
<br />meeting, relative to Theresa Lane, recommendation should be made that it be
<br />turned over to the Streets Committee in connection with dedication. Mr.
<br />Hixson requested that the matter be taken Dare of at this meeting.
<br />Ordinance No. 2814 was introduced by Mr. Hixson. An ordinance accepting for
<br />dedication the plat of N. F. Molnar, Inc. of Lessner Estates Subdivis~:Qa
<br />and declaring an emergency. It was moved by Mr. Hinson, seconded by Mr.
<br />MacDonald, that the statutory rule be suspended and the ordinance be read
<br />immediately the second and third times and put on its passage. The affirmative
<br />vote on said motion was as follows: Hinkel, Hixson, Lynch, MacDonald, O~Neill,
<br />Wilson. Thereupon, the ordinance was read the second and third times and put
<br />upon its passage and the affirmative vote thereon was as follows: Hinkel,
<br />Hixson, Lynch, MacDonald, O~Neill, Wilson.
<br />Ordinance No. 2815 was introduced by Mrs. Lynoh. An ordinance for the ac-
<br />quisition of property for the installation of sidewalks and the widening of
<br />Whitethorne. It was moved by Mrs. Lynch, seconded by Mr. MacDonald, that the
<br />statutory rule be suspended and the ordinance be read immediately the second
<br />and third times and put on its passage. The affirmative vote on said motion
<br />was as follows: Hinkel, Hixson, Lynch, MacDonald, O'Neill, Wilson. Thereupon,
<br />the ordinance was read the second and third times and put upon its passage
<br />and the affirmative vote thereon was as follows: Hinkei, Hixson, ~ynah~
<br />MacDonald, O~Nei11, Wilson.
<br />The Service Director requested that Council consider his recommendation relative
<br />to the survey of the ditches, in order to get proper elevations and alleviate
<br />the present conditions. Mr. MacDonald suggested that the discussion relative
<br />to intensity of work, provisions, culverts etc. could be combined with the
<br />meeting of February 24th. The Mayor requested that action on the matter be
<br />taken as soon as possible., in order that County assistance might be requested.
<br />Mr. Kinchen appeared before Council on behalf of Olmsted Farms Subd. No. 2,
<br />also known as Sunrise Farms Subd. No. 2. He advised that sometime in 1956
<br />a plat was presented for recording purposes only. The plat was subsequently
<br />approved by Planning Commission and transmitted to Council. The conditions
<br />stipulated by the Engineer were met and it was assumed that an ordinance had
<br />been passed for recording purposes. A bond in the amount of 1180,000 was pro-
<br />cured and 15 months premiums were made. More than one year later, they Here
<br />advised by the bonding company that there was no record of a street platted and
<br />a check at the Court House revealed that no plat had been recorded. The plat
<br />has been located by the present Engineer and some of the necessary signatures
<br />appear thereon. At the time it was previously submitted, water approval was
<br />obtained. Mr. Kinchen requested that present Council pass the subdivision
<br />for recording purposes only, in order that the Solicitor can deposit the plat
<br />with an escrow agent of his choice, until such time as the water approval is
<br />obtained.
<br />The Mayor requested the Solicitor to advise as to whether or not this body
<br />could accept the subdivision forrecording and the Solicitor stated that it
<br />could be accepted for recording purposes only, providing the conditions
<br />stipulated at that time were complied with. Mr. Kinchen advised that the
<br />actual condition involved ditch deepening agreements and they were obtained
<br />and turned over to Mr. Dean but, possibly, they may have retained copies.
<br />The Solicitor suggested that arrangements be made for a meeting with Mr.
<br />Kinchen, the City Engineer and himself and he requested Council to advise as
<br />to whether or not they have any other suggested contingencies. Mr. Kinchen
<br />advised that in view of the fact that this is really a continuation of a
<br />street already paved under the old ordinance, and considering that Cmun.cil
<br />is being asked to formalize action of past Council, he would suggest that they
<br />be permitted to go along with previous improvement plans.
<br />It was moved by Mr. O~Neill, seconded by Mr. Wilson, the absence of Wm. H.
