COUNCIL MEETING - JANUARY 20, 1959 - PAGE 2 <br />The Service Director addressed Council with respect to the condition of <br />the VonDuyke property at 25459 Lorain Road. He advised that he had been <br />unaware of the situation until receipt of a communication from the Building <br />Commissioner. He then gave Council a brief history of the past warnings <br />issued by the Building Department and the Fire Department to the property <br />owner and cited a court action whereby a X10.00 fine, per day, was to <br />have been imposed on Mr. VonDuyke in 1957, in the event that the premises <br />were not cleaned up. He submitted photographs as evidence of the condition <br />of the property in violation. <br />The Service Director then recommended that Council request the Solicitor <br />to take necessary measures relative to obtaining a court order, in order <br />to enable the City to tear down the building without any further delay. <br />Mr. O'Neill requested information as to whether or not the wages of the <br />Service Department could be billed, in the event that the suggesteda~tion <br />be taken; and the President of Council advised that after the situation is <br />rectified the expenses could be certified with the Auditor and put on the <br />tag duplicate. <br />It was moved by Mr. MacDonald, seconded by Mr. Hixson, that the Solicitor <br />be directed to secure a court order relative to tearing down the barn on <br />the Von Duyke property at 25459 Lorain Road. "Yeas" Hixson, Kramer, Lynch, <br />MacDonald, O~Neill, Wilson. <br />The Engineer presented the plat of West Park Estates Subdivision No. 4 <br />covering lots to the west of Evergreen Drive and advised that there were <br />no improvements involved. <br />Mr. Hixson stated that he was of the opinion that the plat submitted by <br />West Park Estates should not be accepted for recording purposes, until <br />such time as deed restrictions are filed with the Solicitor. <br />~esalutic~ No. 2800 was introduced by Mr. O'Neill. A resolution accepting <br />for recording purposes only the plat of West Park Estates Subdivision No. 4 <br />for lots west of Evergreen Drive and declaring an emergency. It was moved <br />by 1~Tr. O'Neill, seconded by Mr. MacDonald, that the statutory rule be suspended <br />and the icesolut~su~be read immediately the second and third times and put on <br />its passage. "Yeas", Kramer, Lynch, MacDonald, O'Neill, Wilson. "Nays" Hixson. <br />The above ordinance was given its first reading only. <br />The Engineer submitted the plats <br />5, covering Spruce, Magnolia and <br />set-backs, in all respects, meet <br />North Olmsted. The improvements <br />and sidewalks, were also submitt~ <br />have been alsproved by him. <br />of Olmsted Colon*p, Subdivisions 3, 4 and <br />Elder, and advised that the lot sizes and <br />the Zoning restrictions of the City of <br />plans, covering storm sewer, water, paving <br />sd. Mr. MacDonald <br />advised that he had received information that Westlake has a similar ordinance <br />which they are enforcing. The Engineer stated that he is of the opinion <br />that the ordinance should not be enforced until the program for sanitary <br />sewers has been accepted by the voters; but he stressed the fact that the <br />decision is entirely up to the discretion and :ruling of Council. <br />Mr. Halishak, Engineer for Olmsted Colony, addressed Council relative to <br />deed restrictions and advised that at the time of submission Subdivisions <br />1, 2 and 3 were considered as an entirety and deed restrictions have been <br />carried through on each subdivision. He further stated that all requirements <br />were complied with and would hold true with respect iso all lots in all <br />subdivisions. He also advised that prior to application for building permits <br />a bond will be posted for the sidewalks. <br />
