Park storm sewers. The Porter, Decker,Burns storm sewer had already been <br />included in the budget., and the Great Northern improvements will be provided <br />through bonds, The othe.r two items cannot be included at this time, <br />Mr. Reinhardt Fege, 3985 Ront Road, presented a petition signed by residents <br />in the vicinity of 4PA°° zoned property, between Canterbury and Root Roads <br />requesting that Cluster Zoning not be permitted in this area. The matter was <br />referred to the City Planning Committee of Council, <br />Mr. Levine, Attorney for Famous Homes, appeared before Council to request <br />a change in the Zoning Law to permit a 35-foot setback on property which <br />Famous Homes owne on Doe, Antler and Hunter, so that they will be able to <br />build a larger home, similar to others being: built in the area, The matter <br />had bef?p presented to the Board of Zoning Appeals, who unanimously recommended <br />that the variance be granted. In respcanse to a question about re-platting, <br />Mr. Levine advised that this is economically impossible, since all the utilities <br />are in, and have been put in on the basis of 60-foot lots. <br />It was brought out that when Mr. Mangani reported at the last Council meeting <br />that the City Planning Committee did not go along with a blanket variance in <br />this case, they did not realize that the improvements were in. <br />Mr. Caster requested that the Law Director check on the legality of the Board <br />of Zoning Appeals request for 9 ta 13-foot setbacks, contained in their minutes <br />of March 9th, and that the matter be referred back, into committee. <br />cwl President 0'Neill then requested that the problem be referred to City Planning <br />Committee at their next meeting. <br />Resolution No, 65-32 was given its third reading. A resolution authorizing the <br />transfer of the sanitary sewage treatment plant within North Park Estates Develop- <br />r4ent So. 1 to the City of North Olmsted, Ohio, Mr. Caster moved for the adoption <br />of the resolution, seconded tV Mr. Leonard. Affirmative votes were Caster, Foltz, <br />Hodgins, Leonard, Limpert, West, <br />The Resolution was then read in full, and Mr. Caster moved that Council approve <br />of the order of business in this matter. Motion was seconded by Mr. Leonard. <br />"Yeas" Caster, Foltz, Hodgins, Leonard, Limpert, West, <br />Ordinance No. 65-33 was gzven its third reading and read in full, An ordinance <br />establishing sanitary sewage rates for residents of North Park Estates Subdivi- <br />sion No. 1. Mr. Caster moved for adoptfon of the ordinance, seconded by Mr. <br />Foltz, Affirmative vnte was Caster, Foltz, Hodgins, Leonard, Limpert, West. <br />Ordinance No. 65-48 was given its third reading and read in full. An ordinance <br />providing for the installation of garbage incinerators in newly constructed <br />dwellings. Mr. Leonard moved for adoption of the ordinance, seconded by Mrs. <br />Hodgins, Affirmative vote was Caster, Foltz, Hodgins, Leonard, Limpert, West. <br />Mre Caster moved that the title of Resnlution No. 65-60 be amended to read <br />"Resolution approving for record purposes only Great Northern Boulevard Dedi- <br />cation No. 2, and declaring an emergency."
