Page 7- March 17, 1965 <br />Mr, Caster further stated that he could not see that the Board has a <br />decision to make. <br />Mr, Klinite, Chairman of the Board of Zoning Appeals, who was present, <br />stated he had not had an opportunity to read their minutes, so that he <br />would not comment. He did say, however, that Mr. Caster was asking <br />Council to set aside a ruling, and that it was his understanding that <br />Council only has authority to set rulings aside in certain instances. <br />Mr. Kitchen advised that Council can overrule the Board of Zoning <br />Appeals on a. ruling of interpretation. He stated that Sec, 1133,13 was <br />amended, and prior to the amendment, Council had a right to review rulings <br />within thirty days. The amendment gave a final ruling to the Board of <br />Zoning Appeals on any appeal or request for ruling. On a request for a <br />special permit, Council has a right to overrule the Board of Zoning Appeals. <br />Mr, Limpert moved that Mr. Mangani's absence be excused. Motion was <br />seconded by Mr, Limpert, "Yeas" Caster, Foltz, Hodgins, Leonard, Limpert, <br />West. <br />Mr. West then moved for adjournment, seconded by Mr, Limpert.
