<br />Resolution No. 67-153 was introduced by Mr. Caster. A Resolution
<br />declaring it necessary to improve Sherwood Drive and the public
<br />watercourse traversing Sherwood Drive south of Windsor Drive by
<br />constructing a culvert and the necessary appurtenances thereto, and
<br />declaring an emergency. Mr. Caster moved for suspension of the rule
<br />requiring three separate readings, seconded by Mr. Mangani. Affirma-
<br />tive vote was Caster, Eian, Foltz, Hodgins, Limpert, Mangani, West.
<br />Mr. Caster then moved for adoption, seconded by Mr. Mangani. Affirma-
<br />tive vote was Caster, Eian, Foltz, Hodgins, Limpert, Mangani, West.
<br />Ordinance No. 67-154 was introduced by Mr. Caster. An Ordinance deter-
<br />mining to proceed with the improvement of Sherwood Drive and the public
<br />watercourse traversing Sherwood Drive south of Windsor Drive by con-
<br />structing a culvert and the necessary appurtenances thereto, and
<br />declaring an emergency. Mr. Caster moved for suspension of the rule
<br />requiring three separate readings, seconded by Mr. Ma.ngani. Affirmative
<br />vote was Caster, Eian, Foltz, Hodgins, Limpert, Ma.ngani, West. Mr.
<br />Caster then moved for adoption, seconded by Mr. Ma.ngani. Affirmative
<br />vote was Caster, Eian, Folta, Hodgins, Limpert, Mangani, West.
<br />The Clerk's reported there were sufficient valid signatures on the
<br />initiative petition submitted to Council on May 3, 1967, with regard
<br />to changing the zoning in the area of Kennedy Ridge and Columbia to
<br />A Residence from Mixed Use. Mr. Ma.ngani then read Section 1 of
<br />Article X of the Charter of the City of North Olmsted, which section
<br />outlines the procedure on an initiative petition.
<br />Mr. Mangani explained that it was the feeling of certain members of
<br />Council.that the petition as presented was invalid, by reason of the
<br />description of the property involved, since only part of the area
<br />bounded by the Center line of proposed 1-80, Kennedy Ridge and Columbia
<br />Roads is now zoned Mixed Use.
<br />Mr. Mangani moved that the proposed ordinance be rejected, and the motion
<br />was seconded by Mr. Caster. "Yeas" Caster, Eian, Foltz, HOdgins, Limpert,
<br />Mangani, West.
<br />Mayor Christman suggested that in view of the fact that the petition
<br />has been rejected and undoubtedly will be presented back to Council by
<br />the Committee for putting it on the ballot at the next election, that
<br />Council request the Law Department to study the matter and ascertain
<br />whether or not the petition is legally correct.
<br />Mr. West moved to request the Law Department to study the proposed
<br />ordinance as to its being legally correct, seconded by Mr. Limpert.

<br />Mr. Mangani moved that Council adjourn during the month of July for
<br />vacation. Motion was seconded by Mr. Foltz. "Yeas" Caster, Eian,
