As a result of these meeti*a Ccmudttee cfill <br />request follawing legislation: (a) acaepting £or platting purposea anl.y <br />Sandy Ridge Subdivis&on No. 7, (b) accepting preliminary plans for Samdq <br />Ridge Subdivision No. 9-10-11-I2; (c) scccpting preliminary p lans for <br />Blassom Dover Subdivision No. 1, (d) aceepting for recoxd purnoses anly <br />Kaderbek Subdivisian. <br />3) Canmaittee reccmnends passage of 4xdinance No. 71-143 <br />At this time Mr. West made a mvtian that Council approve the parkiag <br />layout for the Goodman Furniture Store. Motian was secanded bq rir. Baehaex. <br />;?r. Grady discussed plans and Iocation. rtr. i•1est stated a variance had <br />been gxauted by the Zoning Board of Appeals. Mr. Grady questitnud if a <br />different t}?pe of occupant goes into pxemi.aes at a later date, would the <br />new occupant be allowed to operate with Iess parYiag apace because it ia <br />approved now. Ar. Lord said the variatace would have nothina to da with <br />future use. Mr. Prokasy explsi.ned the vsriance graated was for a specific <br />use. If for some reason Che Goadmsn Furniture 5tore did aot sta)* th+ere <br />and anotLier furniture store took ovtr they would be al2awed to eparate <br />because there is no basic change of uee. If a grocery stoze or restaurant <br />weat in there, this would be a chaatge of use ead when an accupancq pearmit <br />is applied for, the Building Commissioner ifouid have to rule on the parking, <br />situation. Once they chan-e the use of a furtaiture store to samething elae <br />they would have to comply with the Code ae expressed. Variance wouid not <br />apply at that time. A variance runs with the use and not with the Iand. <br />Roll call on Motion: Affirntative vote BoehmeT, Grady, Nodgins, Limpert, <br />?'rokasy, Speedling, West. Motion carried. <br />Mr. tvest made a motion that Cauncil disapprove the Olmsted Axms request <br />for rezoning on property at Lorain and Gessner Roads for 8 story apartmeats. <br />Motion was seconaed by Mr. Prokasq. Affi,rmative vote Baehmer, Grady, <br />Kodgins, Limpert, Prokasy, Speedliag, West. Motion carried. <br />Mr. iaest called for a Building, Zoning & Development Committee meetia?; <br />on December 24, 1971, 8:00 p.m. <br />Mr. Limpert, Chairnean Finance Cammittee, reported the follawimg: Finance <br />CdnmitCee aiet regarding transfer of appropriations and making additionsl <br />appropriations :• to caver expendi[ures for rer.?aiader of year. Lesisla- <br />tion governing saiae on agenda; <br />2) re - 4rd. 71-175 - establishinq organizational chart £or Public 4Torks <br />Divisian -Mr. Li.mpert detailed changes made. <br />3) re - bill received for out of pocket expenses fncurred by Citizens <br />Advisory Cananittee on Laad Us*?'in sum of $224.8$. <br />At this [ime Mr. Limgert made a motion that Council auChorize bill submi.tted <br />by the Citizens Comnsittee on Land Use be psid. Motion was seeonded bq 2fr. <br />«est. Affirmative vote Bpehmer, Grady, Hodgins, Limgert, Prokasq, Sgaedling, <br />?Jest. Motion carried.
