<br />Ordinance No. 73-146 introduced by Mr. Giessen was given its second reading.
<br />An Ordinance amending Part 13, entitled, "Building Code", Title One, entitled,
<br />"Residential Standards", Chapter 1301, entitled "Regional Dwelling Code" adapted
<br />Section 1301.05, entitled, "Amendments to Regional Dwelling House Code",
<br />Paragraph E.
<br />Resolution No. 73-147 was introduced by Mr. Lampert. A Resolution awarding
<br />an issue of $345,000 sanitary sewer improvement bonds to the highest bidder,
<br />and declaring an emergency. Mr. Lampert moved for suspension of rule requiring
<br />three separate readings, seconded by Mr. Boehmer. Affirmative vote: Boehmer,
<br />Giessen, Lampert, Prokasy, Beringer, Speedling, West. Mr. Lampert moved for
<br />adoption, seconded by Mr. Boehmer. Affirmative vote: Boehmer, Giessen, Lampert,
<br />Prokasy, Saringer, Speedling, [west. Motion carried. Res. No. 73-147 adopted.
<br />Resolution No. 73-148 was introduced by Mr. Prokasy and given its first reading.
<br />A Resolution declaring the necessity of constructing certain sidewalks on
<br />Aparky Lane, requiring that abutting property comers construct the same, and
<br />declaring an emergency.
<br />Under Old Business:
<br />Mr. Lampert referred to recurring problem of parking of vehciles at Kim's Res-
<br />taurant which vehicles are from the auto dealers next door. Mayor Christman
<br />said the outfit that is in violation is moving out the end of this month.
<br />President O'Neill asked if there was goiag to be a reconsideration by Council
<br />of Red Fox Restaurant Tavern. Proposal, zoning stipulation and legality of
<br />same, actual Court rulings, reference to Board of Zoning Appeals were discussed
<br />thoroughly.
<br />Mrs. Saringer moved that Council reconsider the proposal of Red Fox Restaurant
<br />Tavern. Motion seconded by Mr. West. Affirmative vote: Boehmer, Giessen,
<br />Lampert, Prokasy, Saringer, Speedling, West. Motion carried.
<br />Mr. West moved as was recommendation of Building, Zoning & Development Committee
<br />that Council approve the parking and layout of the Red Fox Restaurant-Tavern.
<br />Motion seconded by Mr. Giessen. Affirmative vote: Giessen, Lampert, Saringer,
<br />West. Negative vote: Prokasy, .Speedling. Abstained: Boehmer. 4 Yeas - 2 Nays -
<br />1 Abstained. Lotion carried. (Reason for Mr. Boehmer abstaining - he is in
<br />restaurant business).
<br />Under New Business:
<br />Mrs. Saringer stated she has received calls on condition of sidewalks on both
<br />sides of Elm Rd. Mr. Prokasy commented on sidewalk repair program throughout
<br />City.
<br />Mr. West requested legislation for dedication of Bern~ood Circle; legislation
<br />to approve for record purposes only the DuBose Subdivision.
<br />Mr. Boehmer moved for adjournment, seconded by Mr. Speedling. Affirmative vote:
<br />Boehmer, Giessen, Lampert, Prokasy, Saringer, Speedling, West. Motion carried.
