Council Minutes of 9-17-74 -2- <br />"" President O'Neill rtferred to letter written by Mr. Childs regarding Equalizatian <br />Board request regarding sidewalk repair program. Mr. Goggle stated Council by <br />law must serve as the Equalisation Board. However, the Committee has discussed <br />Mr. Childs' letter with the balance of Council,~t is felt that the CvNOittse <br />should research the evidence via reports from the Bngineering Department prior <br />to the actual work in order that a fair hearing could be given in that Way. This <br />is in process and will bs taken up at next meeting. These are the people that <br />have sent objections in writing for various reasons; which letters have been seat <br />to the Engineering Department to sake on-site inspections. Anyone having <br />installed sidewalks is entitled to a wring before the Equalization Board if <br />they desire same. Mr. Goggin discussed procedure. <br />President O'Neill requested Mr. Goggin and his Committee to take into consideration <br />letter from Mr. Zubricky. <br />Mr. Giesser, Chairman Building, Zoning & Development Committee and Recreation, <br />Public Parks & Buildings C4esidttee reported the B.Z.&D. Committee stet on <br />September 10, 1974, and following itess were reviewed: 1) Thoatas Nisius Re- <br />Subdivision which is two 40 ft. lots being subdivided into one ~ ft. lot and <br />legislation for same is on agenda; <br />2)D. J. Caldwell Subdivision on Maple Ridge & Walter Rd. - subdividing of two <br />lots and legislation for ease is on agenda; <br />3) Senior Citizen Section 23 Resolution: Requested by the Regional Housing <br />Authority to change our original Section 23 Resolution by inserting the word <br />"designed" for. The Committee felt that the insertion of this Word would change <br />our original intent of the legislstion. The Committee's recoaoeadation is to <br />leave the Resolution go to HtID and stand on its merits the Way it is; <br />4) Assembly of God Church expansion end Committee recommends approval. <br />Mr. Giesser moved that Council approve the parking of the Assembly of God Church, <br />seconded by Mr. Coggin. Affirmative vote: Giesser, Coggin, Lampert, Beringer, <br />Sharpe, West, Wilamosky. Motion carried. <br />5) Chrysler Corporation Deveiops-ent: On application by developer we original <br />required that evergreens be placed on the westerly border of the lot. The people <br />evidently like the lilac bushes that are there; so that the Committee recommended <br />the Building Department to inquire of the residents who that directly affects <br />whether or not they want the lilacs or evergreens. Depending on What the residents <br />choose as their favorite the Committee will go along with. To date have not <br />received word back from the Building Department, as to final outcome. <br />6) discussed a matter that was already passed on the preliminary plans of <br />Columbia Village Subdivision located in back of Dog & Suds. The preliminary <br />plans were approved by Council and new We find out that there was an oversight. <br />The plans do not meet the Code which requires a 50 ft. buffer - the plans only <br />have a 20 ft. buffer. <br />Mr. Giesser moved to reconsider the Colu~-ia Village Development far approval <br />of preliminary plans, second~scl by Mr. West. Affirmative vote: Giesser, Coggin, <br />Lampert, Beringer, Sharpe, West, Wilasosky. Motion carried. <br />Mr. Giesser moved to reject the preliminary pleas of Columbia Village, seconded <br />by Mr. West. Affirmative vote: Giesser, Coggin, Lampert, Beringer, Sharpe, <br />West, Wilamosky. Motion carried. Preliminary plans of Columbia Village rejected. <br />
