Thinks it will take special legislation in order to pay Mr. Childs at this point. Mr. Wilamosky asked Mayor if he will askc_~ Council to appropriate these funds for lit. Childs . Mayor Christman recomtteands that Cottacil crests the position of First Assista~tt Engineer and make it effective as of the fiaet of Maq, and have Mr. Childs sit in this position. President O'Neill verified that the Mayor is requesting a new fob description or position in the organizational chart. Mayor Christman stated that i.s right and it can only be for a liffited tine until the answer comes back on the examination. President O'Neill asked if the I~layor will quote a salary range on this particular position as opposed to what Mr. Childs was receiving in capacity he served. Mayor Christman stated he would recoea~td $18,000. per gear. mayor Chriatwim commented on going above the $18,000 figure rotten Mr. Childs ret~eives his registra- tion. Further, this man can go in the City of Cleveland and coaosnd a far higher salary. President O'Neill commented he does not think there is any question about that. Mr. Wilamosky asked if Mr. Childs has resigned the position. Mayor Christian stated yes - harever, do you resign something you never really had. He is no longer sitting in the position. President O'Neill asked Loa Director Gateau if legislation could have to be prepared to the effect that Mr. Childs would be covered fzowt that period of time that he actually served the Citq. Law Director Gateau stated it either could be done two ways - it could be done on a icetroactive basis or it could be done on the basis of a morals claim. Mr. Caster, Service Director, coeaeented the Mayor did not appoint Kr. Childs - the Mayor announced the fact that Mr. Childs will be filLtag the position of Acting City Engineer. Mr. Caster stated he actually appointed Mr. Childs. Mr. Lampert stated the point is well clear here - it is something that is not new to anyone. Tote Mayor made it quite clear when he suggested Mr. Childs' name, the circtn~tances we were under, Does not think any racks ware uncovered worth talking about. Ttie Mayor admitted this was a mistake and Mr. Lampert feels it is ironic that it was not questioned prior to this. The position is now to resolve it. If Mr. Childs does not pass exaainatioa then we wi11 seek elsewhere for a qualified City Bngineer. Mr. Glilaffiosky stated perhaps he was mislead -perhaps Mayor Chsistss~- did not make the appointment.
