~~ Special Council Meeting 5-14-74 -5- <br />report there is no mention at all of his appointment. <br />President O'Neill referred to Legal Opinion and stated question is now w~-ere <br />do we go from here. Mr. Childs is off the payroll - we will have to see he <br />is compensated for the time he did spend with the City. Presicbsnt O'Neill <br />does not think there is any doubt about the qualifications of Mr. Ch7.ds who, he <br />understandq, is a brilliant man. President O'Neill asked how his krl~ge - <br />technical knowledge of aero dynasics anti air space apply to the Cf~y ae far as <br />engineering. Mayor Christer stated in his position in that capac#ty he had <br />dealings as main contract officer for almost all of their outside work and as <br />such encompassed many aspects in a wide field of engineering. Mr. Childs wi21 <br />be invited to talk to Council if they so choose. <br />President O'Neill referred back tv leg~alaton. Law Directat Gareau st:ted <br />the proposal as related to the legal ~ would be this: In looking at the <br />organizational chart there is one assistant. He believes the proposal is to <br />make a first and a second assistant. According to Charter tine person that has <br />control over the engineering in the City is the Director of Public Service. If <br />proposal were adapted we would be without a "Read" as the Charter calls for: <br />"The Division of Engineering shall be headed by a City Engineer...". It is <br />Law Director's opinion that in the absence of a City Engineer that it would be <br />headed by the Director of Public Service. The Charter specifically stag that <br />the Director of Public Service shall have authority over all of the engineering. <br />Pxesident O'Neill discussed the creation of position of First Assistant and <br />verified with Mayor Christman and Law Director that this proposal far First <br />Assistant would be held by Mx. Childs only until the results of his exa~mi.nation <br />are known and that position would be abolished. <br />Mr. Caster referred to Ord. No. 71-57 •-~ehich listed different positions in <br />Engineering Dept. <br />President O'Neill discussed the establishment of organizational charts by <br />Council and that it would come out of a Committee. <br />President O'Neill referred the subject matter to Mr. Wilamosky, Chairman Zntra <br />Governmental Relations & Legislation Committee, to review statements made by <br />Mayor Christman. <br />Mr. Wilamosky stated he weld appreciate it if the Mayor would submit the <br />recommendation in writing. Mayor said he would be glad to. <br />President O'Neill asked if Cousnittee would like to have Mr. Childs present <br />at the meeting in case there were any questions as to how he feels about the <br />position, etc. <br />Mr. Wilamosky will inform the Clerk when the meeting will be held and at that <br />time the Clerk can contact Mr. Childs. <br />Mr. Lampert asked if it is Mr. Childs we are questioning or the Charter violation. <br />President O'Neill asked Mayor Christman haw critical this is - when ahou~d this <br />be done. Mayor Christman recommended that if possible to proceed with all haste. <br />
