Council Minutes of 12-21-76 _2_ <br />Fresident Lampert scheduled a meeting of Council as a Whole on January 11, 1977, <br />8:00 F.M., City Ha11, to discuss request by Mayor with respect to Stearns Road <br />improvement, and requested the Mayor, City Engineer to be in attendance. Mr. <br />Boehmer will contact Mr. Ron Zurawaki of County Engineer's office and request him <br />to be at meeting. <br />Fresident Lampert announced that Mayor Christman was elected President of the <br />Cuyahoga County Mayors and City Managers Association. <br />finance Director Gerlach reported the Finance Office is moving two doors south; <br />the data processing equipment arrived today after having been lost in transit for <br />two weeks, and is to be installed toc~rrow and hopefully will be all set up in <br />two weeks. <br />Law Director Gareau reported: 1) sometime ago Councilman Wilamosky requested a <br />legal opinion with respect to the installation of additional traffic control <br />devices on Lorain Rd. It was Law Director Gareau's impression at the time there <br />was some controverpy as to whether or not additional signalization could be put <br />on Lorain Rd. because of the fact that in 1971 we had entered into an agreement <br />with Cuyahoga County regarding signalization. Law Director Gareau reviewed the <br />ordinance as well as the agreement in light of the Charter, etc. and found that <br />the ordinance that was passed back in 1971 was contrary to our Charter in that <br />our Charter requires that you can have no emergency clause when you have a joint <br />exercise of control or power and, also, the Charter requires that you have to have <br />three readings. In this particular instance we had neither. In addition, according <br />to the Revised Code a county cannot legally insert in their agreement a provision <br />whereby a City cannot continue to exercise their control of local self government; <br />and this agreement had various clauses that restricted us. Consequently, the <br />Opinion that Law Director Gareau has rendered is that he believes despite the fact <br />that there is a contract in existence that the City can add additional slgnalization; <br />resynchronize or do whatever else they sa desire with respect to Lorain Rd. <br />Mr. Wilamosky stated regarding the Legal Opinion and outcome of Transportation <br />Committee, that he has received requests as of this past weekend from people from <br />Decker Rd. for this traffic light. <br />Mrs. Saringer, Chairman Streets & Drainage Committee, reported: 1) Committee <br />agrees that Ord. No. 76-177 for resurfacing portions of Lorain Rd. in conjunction <br />with Ohio Dept. of Transportation be placed on second reading this evening; <br />2) scheduled a Streets & Drainage Committee meeting on January 6, 1977, 8:30 P.M., <br />City Hall; also to notify the Equalization Board for Mill Rd. improvements to be <br />present. Mrs. Saringer requested the Clerk to ascertain if Mr. Goggin will be <br />available for the meeting before notifying the Equalization Board to be present. <br />Mr. Wilamosky, Chairman Finance Committee, and Long Range Planning Committee, <br />reported: L) Committee recommends flrd. No. 76-182 which deals with the or$anizatianal <br />chart of the Fire Department be passed under suspension of rules this evening and <br />stated reasons - one of which is to save the Finance Department work in preparing <br />payroll because as it now stands the ordinance would be adopted next year and would <br />have to go retroactive; <br />Z) Committee recommends Ord. No. 76-188 be passed under suspension of rules this <br />evening being that it is necessary that appropriations be placed into the necessary <br />funds for the completion of the year. <br />
