Council Minutes of 9 "-76 <br />-5- <br />Mr. Timothy McManauwn, 23213 Staaaybrook Drive, addressed Council and the Law <br />Director regarding the problaaMS ~ hen with his backyard neighbor involving <br />go-carts. Also discussed what transpired with respect to police being called; <br />talking to the Prosecutor, etc. Discussed same with Law Director Gareau.. <br />Mr. Iicl~Ia~namon read letter from his neighbor, Mr. T. A. O'Sourke, who could not <br />be in attendance, regarding the noise, etc. resulting from the go-carts. <br />Mrs. Dolores Beaaett, Stearns lid., addressed Council asking if RTA is going to <br />have a bus out to Brookpsrk and Industrial Parkway in the near future. Mr. Zoldesy <br />stated this is slated for the first part of next year. <br />LEGISLATION: <br />Ordinance No. 7b-224 introduced by Mrs. Sharpe was given its third reading. <br />An Ordinance providing for the amandmec-t of the Zone Map of the City of forth <br />Olmsted, which Zone Map is part of the Zoning Code of the City of forth Oltisted, <br />by changing the premises hereinafter described Eros: single family residence <br />district to general retain business district. Mr. Beaty moved for adoption, <br />seconded by Mr..West. Affirmative vote: Beaty, H~hmer, Goggin, Saringer, <br />West. Negative vote: Wilamosky. 5 Yeas - 1 Nay - Motion carried. Ord. No. <br />75-224 adapted. <br />Ordinance No. 76-99 introduced by Mr. Wilamosky was given its third reading. <br />An Ordinance establishing a new Chapter 745 entitled "hotel and Motel Tax" <br />of the Codified Ordinances of the City of North Olmsted. Mr. Wilamoalky moved <br />for adoption, seconded by Mrs. Beringer. Mr. Wilamosky stated he feels very <br />strongly that this ordinance is a means of generating revenue for the City <br />and will not adversely affect the taxpayers nor the motels of this cos~mity. <br />It is his opinion that this method of revenue which the hotel and Hotel tax <br />will accomplish is sound and this type of tax is not new - many m~icipalities <br />benefit from ordinances similar to 76-99. It imposes a transient tan of 3X on <br />the use of a motel room by which the City can benefit with no disbursement of <br />funds or no additional taxation for the populace of the coar~ruaity sad feels the <br />City can and will benefit substantially by the adoption of this ordinance. Mayor <br />asked if there are any projections of revenue received from such a tax. Mr. <br />Wilamosky said he has prepared soma projections and based on a 50X occupancy <br />his estimate would be in the area of $7,000 to $8,000 per year. Mr. West stated <br />the majority of the Finance Committee voted to turn this ordinance down on the <br />basis that there is only two motels and we would have to set up a procedure to <br />have a tax collection procedure and it would cost the City money and we would, <br />according to the Finance Department, realize very little out of it and put our <br />motels at a disadvantage. Mr. Beaty referred to a study on the tax base of the <br />City which the Jaycees did a couple of years ago and they were against the idea <br />of a hotel sad motel tax and gave reaesons therefor. Mr. Beaty feels thane may be <br />a time in the future where it would be necessary or advsntageoua to set up such a <br />tax but at this time Mr. Beaty cannot see where it would add any additional <br />revenue to make it wortbsehile to go thru with this tax structure what with the <br />additional probl~a with the Finance Department, etc. Mr. Beaty feels wee would <br />put the present motels and hotels at a disadvantage; income would be vas7- little, <br />sad would deter the devalopawae-t of any further motels. Mr. Wlaraty anted <br />on the report of the Jaycees and that the Jaycees felt that it ways dseria~natory. <br />Mayor wondered if any investigation has been made into an A~iasi+eas Tit - we <br />have two theatres, bowling, putt-putt sad he thinks it would be interestfag to <br />try to get a comparison on the possible asaouats of revenue involved nand suggested <br />this be looked into. <br />Roll Call on Adoption: Affirmative vote: Beringer, Wilamosky. ~htgative vote: <br />Beaty, Boeharer, Coggin, West. 4 Nays - 2 Yeas - Motion defeated.
