<br />ORGANIZATIONAL'MEETING dF THE <br />COUNCIL OF THE CITY OF NORTH OLMSTED <br />January 6, 1976 <br />8:d0 P.M. <br />Present: Councilmen Beaty, Boehmer, Goggin, Saringer, Sharpe, West, <br />Wilamosky. <br />Also present: Mayor Ralph Christman, Law Director Michael Gareau, Finance <br />Director William Gerlach,. Service Director Henry Caster, City <br />Engineer J. Howard Childs, Clerk of Council Nora Hill. <br />Absent: President of Council Limpert. <br />In the absence of President Limpert Mr. Wilamosky moved that Mrs. Saringer <br />act as Temporary Chairman for this Organizational Meeting until such time <br />as Council President Pro Tem can be elected. Motion seconded by Mrs. Shappe. <br />Affirmative vote: Beaty, Boehmer, Goggin, Saringer, Sharpe, West, Wilamosky. <br />Motion carried. <br />Mr. Goggin moved to nominate Mr. West as President Pro Tem, seconded by <br />Mr. Beaty. <br />Temporary Chairman Saringer explained why there is a Temporary Chairman and <br />the first order of business would be to amend the Agenda. <br />Mr. Wilamosky stated the Rules, as he understands and he has discussed <br />the matter with our Law Department - the Rules that the Council of 1975 <br />adopted must be reaffirmed or amended; but they must be re-adopted by the <br />Council of 1976. The Rules of Council provide for a Council President Pro Tem; <br />and before we go any further we should move to adopt the Rules of Council to <br />provide for a Council President Pro Tem. <br />Temporary Chairman Saringer stated that is her understanding also and that the <br />first order of business would be to include the adoption of the Rules of <br />Council and amend the Agenda and asked if there is a motion. <br />Clerk pointed out there is a motion on the floor. <br />Mr. Wilamosky stated he did not believe the motion is in order. <br />Temporary Chairman Saringer asked Law Director Gareau for his opinion. <br />Law Director Gareau stated Mr. Wilamosky had previously asked him with respect <br />to the procedure of adopting Rules of Council. Mr. Gareau had occasion to <br />research this question and did find through his research not only with respect <br />to publications of various municipal law treaties that, in addition, there was <br />an Attorney General's opinion issued on the subject; and that being that Rules <br />of Council must be ratified and confirmed for every term. In other words <br />they do not carry over from one term to the next term; and they can be <br />ratified by basically use acquiescence or they can be ratified by form of <br />~.~. <br />
