Council Minutes of 9-20-77 -3- <br />dealing with the very same subject matter where the Supreme Court ruled that the <br />City is clothed with governmental ia~ity; <br />3) Law Director Gareau has been cossmsc-icating with Mrs. Sharpe with respect to the <br />possibility of amending the Zoning Code for including a classification within Hi-Rise <br />District for housing for the elderly. In other words, housing for the elderly <br />would be permitted in the districts that ws now have zoned for Mixed Use. Once <br />the draft is presented and gone over by the B.Z.& D. Committee, Council can review <br />same: it has some advantages of avoiding the referendum because it is not really <br />adding to be ire multi-family - it would be just utilizing what we have: qou would <br />not have to have a variance to do it; <br />4) Ord. No. 77-168 was prepared by request of Mrs. Saringer. It incorporates some <br />of the provisions of the Pare~+a Code dealing with the displaying of materials <br />harmful to juveniles: if you look at it closely you will see that it is almost the <br />same as our existing code section dealing with that subject. The only thing that <br />it does is it adds the displaying of these materials: all the other things are <br />presently in the ordinance; <br />S) Mr. Boehmer last week regeyested a written legal opinion with respect to placing <br />boulders or rocks within the tree lawns of the various subdivisions: Law Director <br />Gareau has done research, but has not had an opportunity became of the ordinance <br />work that has been performed this past week, to put it in writing. Law Diredetor <br />Gareau stated the Supreme Court has ruled on the subject and basically it at~unts <br />to if the City maintains a nuisance within the right of way area - mait-ly the tree <br />lawn, and somebody who is lawfully using the tree lama becomes injured thsa~ we are <br />liable. The question is - is a boulder a nuisance when a car hits it and Law <br />Director Gareau thinks the question would be clearly no, that it isn't; <br />but if a jour „ is running at night on the tree lawn and hits a boulder then we <br />have a problem. This is something Council will have to discuss and advise the <br />Law Director where they want to go. <br />Mrs. Saringer, Chairman Streets & Drainage Committee, reported Committee met on <br />September 13th: the only project dfscwsed was the resurfacing of Claque Road <br />between Lorain Rd. to the North Olmsted Corporation line. The Committee concurs <br />to give consent to the Mayor to enter into an agreement with the County. This would <br />be financed by $5. Motor Vehicle License Tax Fund; <br />2) there were several items Mrs. Saringer wanted to discuss at that meeting; however, <br />due to the inclement weather that evening, the Service Department Reads weren't <br />available. City Engineer Childs answered tonight several questions Mrs. Saringer <br />had . <br />Mr. Beaty, Chairman Transportation Committee, reported Committee recommends <br />passage of Ord. No. 77-143 - authorising the sale of some of the surplus equipment, <br />which legislation is on second reading tonight. <br />Mr. Boehmer, Chairman Intra Governmental Relations ~ Legislation Committee, and <br />Public Safety, Health & Welfare Cammittee, reported Committee met on September <br />13th to discuss with Mr. Copeland, Director of Dept. of Human Resources, the <br />Youth Diversionary Project which is now in effect in our City. This is a program <br />to help juveniles that get into trouble: Juvenile Officer Gabe Dellapasta is also <br />working with this project and hopefully the program is going to help juveniles <br />stay ouC of trouble; <br />2) Safety Committee met last night with residents and people. of homeowners <br />associations and discussed problemm througt~ut the City as far as turfing, vandalism, <br />etc. The Police Department and Members of Council were in attendance and the meeting <br />~,~,~~~,.. e~~~~ <br />
