Council Minutes of 4-19-77 -^Z-- <br />Law Director Gareau reported: 1)repoxted to Council a couple of mseL~B agcy that <br />we are involved is a lawsuit regarding the infamous trae at the Big d Oldsmobile. <br />The briefs have been submitted on behalf of the Big 0 Oldsmobile and Law Director <br />Gareau is presently preparing a brief on behalf of the City. Once the briefs are <br />submitted the Judge will undoubtedly hear on the briefs so we should probablq have <br />a decis'on on that within the next 30 days. <br />Mrs. Saringer, Chairman Streets & Drainage Comsai.ttee, scheduled a Streets & Drainage <br />Committee meeting on April 27, 1977, 7:15 P.M., City Hall, and requested the City <br />Engineer to be in attendance. <br />Mr. Boehmer, Chairman Intro Governmental Relations & Legislation Committee and <br />Public Safety, Health & Welfare Committee, reported Committees met on April 18th <br />and discussed the Affirmative Action Program and it is hoped Council will adopt <br />same and legislation will be requested tonight; <br />2) Committee discussed Ord. Na. 77-54 which amends Sect. 351.11 entitled "Truck <br />Parking in Residential and Business Districts" and Committee felt this ordinance <br />is a worthy one and recommends adoption. <br />Mrs. Saringer added that Committee discussed Res. No. 77-73 which is on the agenda <br />and Conraittee is in agreement to request suspension of the rule on this legislation <br />this evening. <br />Mr. West, Chairman Environmental Control Committee, reported: 1} at the request <br />of the Recreation Commission and because of the timing will ask for suspension of <br />the rule on Res. No. 77-63 - advertising for bids for a pick-up truck for the <br />Recreation Department; and on Res. No. 77-62 -advertising for bids for construction <br />of a cement block storage building at Claque Park; <br />2) announced an Environmental Control Committee meeting on May 2, 1977, 8:15 p.m., <br />City Hall. <br />Letters, Communications: <br />Clerk read letter from Mayor Christman to the Clerk which letter stated that the <br />Mayor is returning Ord. No. 77-42 to the Clerk unsigned, further stating that the <br />Mayor is still of the feeling that by assigning priorities to streets for <br />resurfacing, Council is assuming administrative duties. <br />Clerk read following letter from Mayor Christman to the Clerk with respect to Ord. <br />No. 76-141: "I am returning Ord. No. 76-141 to you unsigned and vetoed for the <br />following reasons: I) The traffic signals presently existing for the entire <br />length of Lorain Rd. were installed under a contract with Cuyahoga County in <br />cooperation with the state and federal government. This contract states that addi- <br />tional lights may not be installed without the approval of the County for a period <br />of five years. Y feel that the City of North Olmsted made these comm~.tments in <br />good faith and should honor them. The lights were installed only after thorough <br />and competent study of traffic at each and every intersection along Lorain Rd. <br />Signalization, too, was executed only after a thorough study and is warranted by <br />predetermined criteria used to justify same. <br />2) Helter-skelter installation of traffic signals will seriously affect the smooth <br />flow of traffic along Lorain Rd. <br />3) The few times during the day when there may be traffic congestion at this <br />intersection do not, in my mind, 3ustify an expenditure of from $5,000 - $6,000 <br />i.n materials to properly signalize the intersection. <br />4) At Council's request, the intersection has been studied by the Safety Director. <br />
