Mi:PIUTES OF T"dE MEETING OF -THE COUNCIL <br />OF THE CITY OF NORTH ULMSTED <br />NOVEMBER 21, 1976 <br />Present: President Dewey H. Limpert, Councilmen Beaty, Boehmer, Logan, Petrigac, <br />Saringer, Sharpe, Wilamosky. <br />Also present: Mayor Robert TJ. Swietyniowski, Law Director Michael Gareau, <br />Finance Director Robert Brockman, Safety Director Eugene Petre, <br />Service Director Joseph Corrigan, Clerk of Council Florence Campbell. <br />"_•ieeting was called to order by President Limpert at 8:00 P.M. <br />President Limpert announced that Ordinance No. 78-145 and Resolution No. 78-152 have <br />been removed from agenda and put back into committee; Ordinance No. 78-165 has been <br />added to agenda and will be explained in Mx. Wilamasky's xeport. <br />Minutes of Council Meeting of November 8, 1978, were approved as read. <br />Law Director Gareau reported: 1) the Margol~.us case with respect to collection of <br />refuse from commercial and multi-family dwellings was supposed to go to trial to- <br />morrow; however, in lieu of a trial, the fudge has consented to stipulations with <br />submission of briefs within 30 days. <br />2) the Burkett case, which is the sewer odor case, instead of being tried December <br />4th as it was initially scheduled, is now scheduled for the middle of January be- <br />cause of scheduling problems of all the lawyers involved. <br />Mr. Beaty asked the Law Director about the disposition of the suit on the Rec Complex <br />roof. Mr. Gareau replied it is scheduled for a pretrial sometime in January in <br />Rocky River Court. Originally sued Forepaugh - Forepaugh in turn brought in by <br />third party complaint about three other third party defendants. Each of them has <br />28 days to file their answers and they all have not filed. <br />Mr. Logan asked the Law Director if there was any possibility in light of the deteri- <br />oration of the tobaggon run at the Rec Complex to add that to the case. Mr. Gareau <br />stated it can't be done. Mr. Logan asked if the City could file a separate suit <br />against the general. contractor., rir. Beata said the fault was probably in design. <br />Mr. Gareau said. the City would need an expert who would be willing to testify if <br />the fault is in design, or construction, or quality of material, and whose fault it <br />is, and then the City can go after them. Mr. Logan requested the Mayor have the <br />Engineering Department take on this task. Mr. Beaty suggested the Engineering <br />Department could get in touch with someone caho could come in as an expert on this. <br />Law Director Gareau said it should be someone who is either an architect or struchir- <br />al engineer. Mayor said he would look into this and work with the Law Director. <br />Safety Director Petre reported: 1) last week discussed the problem encountered on <br />Lorain Road, primarily between Silverdale and Sparky Lane. Has addressed himself to <br />the Safety Committee and Council and reviewed the area with reference to the number <br />o* accider..ts, etc. which occurred in that area. Furthermore, contacted by mail the <br />various merchants in question on the north side of the road with reference to setting <br />up a meeting to discuss the problem. Tomorrow, letters will go out again to the <br />interested parties advising them of the meeting at 4 P.M., Wednesdaq, November 29th, <br />here in the Caucus Room at City Hall. <br />2~ some people recently have asked about our phosphate ordinance. Have performed <br />inspections at virtually every known retailer who sells detergents in the C1,ty of <br />North Olmsted. As of this date, have total compliance - shall cvr.~~inue to spot <br />
