Council Minutes of 9~5-78 ,7_
Secondly, the State of'Ohio, along with the Charter of the City of North Olmsted,
establises minimum notice requirements for public bidding. It has to be adver-
tized at least two weeks in a s~rw. The time limitaEtons can be eststt~ded, however
due to the fact that the policies were e~iring, the deadline be~aame shortened.
The Board of Control has alreaaiy aararded the contract and to resc~ad or set it
aside would be a breach of cetatxa~ct for which the City could be bald liable.
In his opinion, we caasaot set aside the cataract which tree bit d. As to
whether or not the coua~il, or the people for that matter, ctra d or do
something differently with respect to pc~lic bidding, yes, they Ha have an
ordinance tonight that would haves the public bidding lade ueder the darter dove-
tail with that of the State of Ahio with res~+ect to mini~t pu~-Iic bidding. We
could also have Charter is to e~ttsastd the time.. There is a little bit to
be desired in our Charter in respect to pt~lic bidding anyway. iN- no
provision for emergency purchases arttich 3n my opinion is aesccusa~rle sad every
time it has gone before the voters of the City to expand and clarify those
sections of the Charter, the people have turned it down.
