Council Minutes of b-7-78 <br />-2- <br />Service Director Corrigan discussed the City's cost of $k21,000 - which is a rough <br />analysis - with Mr. Beaty, and how such figure was arrived, etc. <br />City Sagineex Zurawski reported: 1) the contractor is back on the Clague Road <br />culvert project to put the final touches - the final grading, sidewalks, sad <br />pedestrian bridge. Rapafully that work should be cos~le~ted by the said of the month; <br />2) on June 20th ODOT will be ciug tba bide for the Columbia Rfl~ and Lorain Road <br />resurfacing projects. The coaplet~.c~a date is October 15th; <br />3) on June 1st, the apparent low bl.d~r for the double 0 section of I-4-80 was the <br />Great Lakes Construction y of Cleveland. That work should also begin soon. <br />Attended a pre-construction s~aeti~ on the section between McRasasie and brace Road: <br />the contractor for that section is the Aorvit$ Construction Company; <br />4) had previously x~sported to Council about amgnesite concrete: did a trial appli- <br />cation of that on the curb lase of Park Ridge Road for the southbound action. City <br />&ctgineer Zurawaki was disappointed in the quality of the workmanship in that section <br />and he reported that to the Sitwt C~rpa~tty who assured him they will come in at their <br />cost and do a toeu:h-up on the curb lie. City Bngineer Zurawsfci thiaka we should <br />experiment further on the use of that ~tterial and stated reasons therefor;the pavement <br />this such isproved to what it had been prior to the application; <br />5} all of the data has been collected for the Brookpark Road survey and it has been <br />finalized into foam which will be subffiitted tomorrow to ODOT District 12. <br />Mr. Logan stated he would like to personally thank Mr. Zurawski with respect to <br />the completion of the Brookpark Road survey and the engineering and traffic <br />investigation. Tt was at ~c. Logtxt's request that this was done and Mr. Zurawaki <br />has completed in excess of 8!? hours of his own time on this project as well as over <br />30 hours of departaent t.mm. tfr. Logan stated Mr. Zurawski deserves credit for <br />saving the City a large of ~roney that the City would necessarily have to pay <br />an outside firm to do the study, etc. <br />Law Director Gateau reported: 1} several mcmtha ago had reported oa the Sig 0 Case: <br />The City had sought an injunction to restrain the 'Sig 0 Dealership from eliminating <br />one of the trees that they arg~aaaally included in the development plan when it was <br />submitted by Uuhl~wan Oldsmobile sad they, in turn, tried to have the court permit <br />them to cut the tree down. The Court had ruled in favor of the City and sstrained <br />them from taking the tree down. They had filed an additional motion asking for a <br />new trial and this past week the Court overruled that motion and if they are going <br />to appeal it, they will have to take it to the Court of Appeals; <br />2} most of the people is this x^eom were not around when the Baldwin Case was <br />originally tried before the Civil Service Commission. That case involved a police <br />officer of the City who was d3aMeharged by the City. The case was taken to the <br />Civil Service Com~assiaa: the Civil Service Cosmuission reversed the decision and <br />merely suspended the officer sad reduced him in rank. The Citp appealed - at that <br />time Mr. Gateau was not Law Director - and the case was referred out to Squires, <br />Sanders & De~sey. They have w~-rked on it these 4 years. It went into Gammon Pleas <br />Court - the Commo~- Pleas Court upheld the City's appeal and the officer was <br />discharged. This past week tyre Court of Appeals upheld the ComAwn Pleas Court and <br />Law Director has not heard w~tether or not that will be appealed to the Supremo Court; <br />3) today filed a lawsuit on behalf of the City seeking an injunction against a <br />property owner on Louis Drive from utilizing a single residential property far multi- <br />family purposes; <br />4) since last Council Meeting ham issued a Legal Opinion dealing with the garbage <br />incentive program. The opinion is in the office of the Clerk of Council. Basically, <br /> <br />
