Council Minutes of 6-7-7$ -3- <br />Law Director Gareau told that Council is the only bp~ty in the City tit has the <br />authority to set wages. 1~he ordinance adopting tl~ t~ora+o~duer of [tderatanding <br />and the Memorandua of Understanding have no reference whatsoever to the garbage <br />incentive program. As a matter of fact, the l~arat~dum of rstas~ulug establishes <br />that the work day is 8 hours and the work week is sfl hours, and anycm:e who is to be <br />paid overtime would have to work obviously in excess of 8 hours; in excess of 40 hours <br />a week and it has not been administered that w+l~y. Consequently, the progras, im <br />Law Director Gateau's opisam;, is csattary to la~o. The Council has the authority <br />to establish a different pay schedule on a daily basis; however, that is Council's <br />prerogative and in the past Coua~il has not estahliehed that prergram. It has been <br />administratively handled. Also at t~ same time, Law Director Gareau ruled that <br />this. was not the subject of a grievance procedure wlxich would ee~tually wind up <br />in the courts presusably. If it was taken to the step 4 grievance it would wind <br />up in arbitration and Law Director Gareau ruled it was not proper to arbitrate <br />a case like this because it dealt with the interpretation of the City Charter; and <br />arbitration being binding arbitration Law Director Gareau does not thi~c it is proper <br />for an arbitrator to determine what our Charter saps and how it should be implemented. <br />Safety Director Petre reported: 1) Concert in the Park was held last Sunday by the <br />Cleveland Federa'ticx: of Musicians at-d those in atteddauce enjoyed same; <br />2} the Jaycees' project this year again will be to asas~le and paint some of the <br />needed picnic tables for dust ~-ascks as well as the park area behind the ttee Center <br />that we would like to develt~. 't'his psroject should be completed by the Jaycees bq <br />month's end; <br />3)the personnel of the tLec Cot~3~rx ara ~sia~ as outstanding job in increasing the <br />number of programs s~ income by add.ng the motion of hockey ptagrarrs and figure <br />skating and swim pro~Ams during tl~ sueao~er. This should said considerable revenue <br />over a like period o€' titre previously; <br />4) Che LEAA grant stisson is vsxy close and should be in Washington in the near <br />future; and thanked s11 involved for their contributions; <br />Mrs. Petrigac, Chaixman I3mvironarental Control Committee, reported Conssi.ttee did not <br />meet officially; however, Mrs.. Petrigac hit an opportunity to go thru our Wastewater <br />Treatment Plant and was i~resasd aarrl. ed to see the far-sighted planning that <br />went into this plants also was i~!reaaed with tea clean and well marnaged the plant <br />is. Feels our Treat~sn.t Plant is a real plus for this community and thanked Mr. <br />Crider for the tour. Is looking fos~srd to the taut through the four lift stations <br />and would like to invite anyoAe inteted to accompany her on this, tour. Also, <br />glad to see the classes from the tsi.~t school on these tours; <br />2} Mrs. Petrigac and the rest of Coa~atittae are happy to hear that the Mayor received <br />different information than the infdxrrtrtian he reported to her in his letter in <br />response to her question of qty kith i~- regard to a representative being appointed <br />to the planning team of the tltOse Control and Land Use Compatibility Committee. <br />Is glad we will sow have a representative and thin tare Mayor's choice of Mr. <br />Zurawski is an excellent one. <br />Mr. Boehmer, Chairarew Public Safety, Health & Welfare Committee and Transportation <br />Committee, reported: l) at last Council luting Council objected to the issuance <br />of a new DU5 -6 liquor permit to Magic Pan, Inc., 5281 Great Northern Blvd. because <br />of a wrong address. The correct address for the Magic Pan, Inc., is 5281 Great <br />Northern Mall. <br />Mr. Boehmer moved for reconsideration, seconded by Mr. Beaty. Affirmative votes <br />
