<br />Mr. Woerpel, Chairman Building, Zoning and Development Committee reported: 1) OrdinT
<br />ance No. 83-136 has been auended to include recommendation of Planning Commission.
<br />Last sentance of Paragraph C,_ "I1lumination of Signs" now reads: "In no event shall
<br />that portion of a pole sign, which is considered to be the supporting column, be
<br />illuminated from within or by lighting attached to said column".
<br />2) Planning Commission, at its December 13th meeting, unanimously re,jected the pro-
<br />posal to construct an addition at Rini's Supermarket, 26035 Lorain Road.
<br />3) Planning Commission heard Mr. Woerpel's presentation regarding Mr. Sparky DiRenedetto's
<br />request to rezone a portion of his property on Brookpark Extension. Commission will
<br />discuss this, as a definite f_ormal agenda item, at a later meeting, with proper notifi-
<br />cation to the people involved.
<br />4) Commission also discussed Or_dinanee No. 83-124 and suggests that the B7D Committee
<br />cant:inute to review this ordinance and consider such items as: Is Chapter 1241 of the
<br />Zoning Code, entitled "Amendments", the proper place for this new section;_Signage and
<br />Lighting; Height regulation; Is pump relocation considered part of an existing station
<br />or is it a new service station. Commission indicated they would like to review each
<br />proposal. Mr. Woerpel suggested the new RZD Coimnittee of Council study Ordinance No.
<br />83-124 further, early in 1984, and make appropriate changQS.
<br />5) Ordinance No. 83-137 was also discussed; has aistributed excerpts f_rom the Planning
<br />Commission minutes pertaining to the ordinance, with their recoannendationse ordinance
<br />is in the process of being amended.
<br />6) Two special permits were granted by the Board of Zoning Appeals at their necember 7,
<br />1983., meeting. Asked if Council wished to overrule the Board of Zoning Avpeals in
<br />either instance. A special permit was granted to add to a non-conforming dwelling for
<br />Charles Busanus, 4555 Selhurst; special perrnit was granted to use a non-conforming
<br />pole sign by L'Escargot (formerly LaValle's), 25984, Lorain Road.
<br />Mr. Logan pointed out that Council recently adopted a new section regarding pole signs
<br />which required more restrictive pole sign locations. The Board of Zoning Appeals has
<br />regularly allowed signs to remain in their non-conf_orming location when a new business
<br />comes in. When a new business comes in, these special permits should be rejected.
<br />Mr. Logan moved Council overturn the Board of Zoning_Appeals special permit, granted to
<br />L'Escargot, 25984 Lorain Road, as per the December 7, 1983, ruling, second by
<br />Mr. Wilamosky. Discussion ensued as to whether this was classified as a special permit
<br />and a variance or just a special permit. Language in the minutes of the BZA Meeting of
<br />December 7, 1983, refer to it as both a variance and special permit. Mr. G]oerpel
<br />suggested, in view of the confusion of the languap,e, that the matter be referred back
<br />to the BZA with a request for clarification. Also, that at the next Council Meeting,
<br />a motion be passed directing the Board of Zoning Appeals to be tougher, to be more
<br />restrictive and to more fully .carry out the intent of Council. Mr. Togan withdrew his
<br />motion; Mr. Wilamosky withdrew his second.
<br />7) Mr. Taoerpel conc]_uded his report by stating that for the past fifteen months or so,
<br />the BZD Committee has been in communication with both the Planning CoBnnission and the
<br />Board of Zoning Appeals regarding possible Zoning Gode changes, including changes
<br />affecting fencing around swimming pools, regulations regarding patio covers, gazebos,
<br />satellite discs, general use restrictions, signs in general, si€;ns at the Great Northern
<br />Mall and fencing in commercial districts. B7.D Coimnittee has not been able to address all
<br />of these concerns„ has given a copy of notes and letter from the Planning Commission,
<br />as part of this report, to the Clerk of Council with the request that they be forwarded
<br />to the new BZD Committee Chairman for review and any appropriate action.
