.. e _. . <br />MINUTES OF THE MEFTING OF THE COUNGIL <br />OF THE CITY OF NORTH OLMSTED <br />NOXTEMBFR 15, 1983 <br />Present: President James Boehmer, Councilmen Bierman, Logan, McKay, <br />Petrigac, Woernel. (Mrs. Saringer resi.gned at 9:35 P.M.) <br />Also present: *4ayor Robert Swietyniawski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Safety Director Fugene Petre, Service <br />Director Joseph Corrigan, Clerl: of Council Florence Campbell. <br />Absent- Councilman Wilamosky (present at 9 P.M.) <br />Meeting was called to order by President Boehmer at 8:00 P.M. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of the Council Meeting of November l, 1983, were approved as corrected; <br />Page 4, Item 5 of Mr. McKay's Safety Committee Report was changed to read <br />"Mr. McKa_y" moved, not "Mr. [Joerpel" moved. <br />President Boehmer announced that Ordinance No. 83-138, an ordinance providing for the <br />amendment of the Zone Map of the City of North Olmsted, which 7.one Map is part of the <br />Zoning Code of the City of North Olmsted, by chan.ging the premises herein,after <br />described from C Single Residence District to Multinle Residence Lliatrict, was being <br />added to the agenda. Also, Ordinance No. 83-128 an ordinance creating a new fund, <br />known as the Youth Program Fund, would be removed. <br />Finance Director Bo_yle reported: 1) Because of recent banking law changes, City has <br />closed some money ma.rket accounts; money has been transferred to negotiable order of <br />withdrawal accounts. <br />2) A law suit was recently filed by the State of T,lashington, against the Internal <br />Revenue Service, to change some rulings against refunding long term debt. Aas re- <br />quested Mr. John Larson of Squire, Sanders and Dempsey to investigate to see if there <br />is any possibility of the City refinancing long term debt. Upon hearing from Mr. Larson, <br />will report further to Council. <br />3) Has no further word with respect to revenue sharing; this sti11 has not been passed. <br />Law Director C.areau reported: 1) Had a preliminary injunction hearing with respect to <br />the Med Center/King's Path law suit. Had filed a motion to dismiss. Two hearings <br />were held and the Judge ruled on the motion to dismiss and has dismissed the City of <br />North Olmsted frcam the law suit. <br />2) Several years ago, Citv filed a complaint against a propertv owner on David Drive <br />who had constructed a tool shed without a permit and refused to take it down. This <br />situation has been resolved and the nronerty o?aner has agreed to reduce the height of <br />the shed to eight feet. <br />3) Pre-trial hearing on the declaratory judgment action with respect to the Margolius <br />zoning issue on Columbia was held and this matter has heen set for trial in January <br />of 1984. <br />4) A law suit has been filed against the City of North Olmsted by Great Northern <br />Properties with respect to the Zoning Roard of Appeals ruling regarding the "through <br />lot" question on the Rini pranerty. This is a declaratory .judgment action, requesting <br />no damages.
