Council Minutes of 11/1/83 -2- <br />2) With respect to the Med Center, King's Path Condominium Assaciation has filed a <br />motion for a preliminary injunction. Ztao hearings were held in the last two weeks. <br />With respect to the preliminary injunction hearing, the Association did agree to <br />withdraw its complaint for that nhase against the City of rTorth OZmsted. Law Director <br />will continue to attend the hearings because any evidence submitted at this stage is <br />also admitted for the final. hearing and he wants to make sure the record is pro- <br />tected. Although the Judge was suoposed to have handed down a ruling today, regarding <br />the preliminary injuction, Law Director has not been informed as yet. <br />Safety Director Petre reported: 1) Gave a brief financial report on the Rec Complex. <br />Through September of 1983, revenues have increased $54,217; expenses decreased <br />$68,339. income for October is almost $4,000 over last _year. Congratulated the <br />Recreation Director, Jerry Couts, and the staff. <br />2) City of Westlake opened bids today for the traffic signal at Columbia, Rose and <br />Fawn. The bids and agreement to maintain the signal should be finaZized within <br />the next two weeks. Westlake and North Olmsted will split cost o£ signalization. <br />3) Received written information from Progressive Equipment Corvoration of Erie, <br />Pennsylvania, regarding a used 200 ton cooling tower the_y have for sale. Is presently <br />determining if this cooling tower is adequate for use at the Rec Complex. <br />4) Over the past six or seven years, Council and the Administration had discussed the <br />business district areas and p roposed speed limit changes. Feels Council should <br />develop legislation to better identify business district as being an area on Lorain <br />Road, from Stearns eastward to the Fairview line, and change the speed 1imit to <br />25 miles per hour within said district. Lorain Road carries the major portion of <br />vehicular traffic with the majority of accidents occurring in the above described <br />area. Would like this issue to be considered by the Saf_ety Committee of Council. <br />Mr. Logan requested in£ormatfon regarding what portion of the accidents were speed <br />related, as well as a definition of terms. <br />Mr. Wilamosky pointed out that in his research of this area, specifically in the <br />area of McKenzie to Decker, he found that it did not meet the warrants as prescribed <br />by the State's statutes in setting speed limits in business districts in the State <br />of Ohio on a state highway. Feels Council should look at whether the existing posting <br />in this area meets the statutes as it relates- to the number of businesses in this <br />prescribed district before changing to a 25 mile an hour speed zone. <br />General discussion ensued regarding the Erie, Pennsylvania, cooling tower and Ordin- <br />ance No. 83-131, requested by Mrs. Petrigac, which would transfer appropriations <br />from the Office of Budget and Management for its purchase, <br />Mr. Woerpel, Chairman Building, Zoning and Development Committee xeported: 1) BZD <br />Committee met at 7;30 P.M.a October 27, with all members present. Also pxesent <br />was Building Commissioner Gundy who presented the following requests: <br />a. Med Center, 25757 Lorain Road, pole sign xequest. Request was <br />approved by Architectural Board o£ Review on October 19th and Planning Connnission <br />on October 25th, witfi the exception of the recoannendation of ARB regarding the color <br />on the side of the sign. Committee recommends approval as per Planning Commission. <br />Mr. Woerpel moved Council approve the pole sign request as stated, second by <br />Mr. Bierman, unanimously approved. <br />4D b. Christ the King Community. Proposal to construct three crosses <br />on their pxoperty; location approved by ODOT. Approved by ARB on October 19th and <br />Planning Commission on October 25th. Committee recommends approval. Mr. Iaoerpel <br />moved Council approve the proposal to construct three crosses as stated, second by <br />Mr. McKay, unanimously approved. <br />,? ??+?
