. <br />Council Minutes of 9/6/83 -2- <br />Law Director Gareau reported: 1) The Jandecka Case, in which Officer Jandecka <br />sought to appeal to the Civil Service Commission regarding a five day suspension, <br />was decided in favor of the City of North Olmsted. An appeal was taken on the <br />decision, which will ncpw go to the Eighth Appellate District Court. <br />2) A grievance has been filed, by police officers, dealing with "show-up time" or <br />time they are given for going to court on their off-time. The grievance went <br />through the established ordinance procedure; an action has been filed in Comcnon <br />Pleas Court, asking that the court declare their right to receive compensation, <br />even if it runs into their regular tour of duty. City of North Olmsted has denied <br />the grievance; the officers are asking the court to make a determination. <br />3) City is also involved in litigation; King's Path Condominium has filed a lawsuit <br />for $1,250,000 dealing with a developer tying into an existing storm sewer which <br />runs on their property. City has turned this over to the insurance company, however <br />Law Director expects to become active in the cage, asking that the case be dis- <br />missed because the City only taok the word of the attorney for the developer and <br />did not, personally, look into the sewer: City only permitted them to establish a <br />proper drainage program, which happened to include hooking into a system that <br />their attorney said they liad a right to hook into. <br />Safety Director Petre reported: 1) Complemented Mr. Phil Nagy, Community Council, <br />and every service organization a.rid person who contributed to fiomecoming this year. <br />2) Rec Complex ice rink has recentl.p been painted; renairs to fencing around the <br />rink will start shortly. Fall Program is off the ground. Have been discussing <br />the possibility of selling lotter„y tickets at the Complex; will advise further. <br />3) Members of the Fire Department recently undergoing surgery are Assistant Fire <br />Chief, Richard Limpert; Captain Richard Smith; Fireman Richard Donaldson. <br />4) Patrolman Gerald Tehoke was struck by a hit/skip motorist while on the scene <br />of an accident and may possibly be off work for as long as one year. <br />5) Patrolman Richard Novak also underwent surgery and is expected baek in 4/6 weeks. <br />6) Members of the Fire Department, lead by Lt. Donald Herrman, did some vutstanding <br />work in repairing Engine No. 1, enabling the City to receive a Nati,onal Testing <br />Certificate. Next project will be repairs to the 196$ American LaFrance truck. <br />7) Auction for surplus vehicles and m3.scellaneous items will be held at the Rec <br />Complex on September 17th at 9 a.m. <br />8) Newest Member to the Recreation Cominission is Mr. Robert Knopf, School Board's <br />representative. <br />Mr. Woerpel, Chairman Building, Zoning and Development Committee reported: 1) BZD <br />Committee met Thursday, Ju1y 28th, at 7:35 P.M., with Mr. Woerpel and Mr. Bierman <br />in attendance, as well as Building Comrnissioner Gundy, The following Building <br />Department requests were considered: <br />(a) Sopata Construction Company, 24834 Lorain Road. Proposal to alter <br />existing dwelling for offices and construct addition for a garage, as well as <br />proposed wall sign; approved by ARB on June 22, 1983 and Planning Commission on <br />June 28, 1983. BZD Committee recommends avproval as submitted. Mr. Woerpel moved <br />Council approve proposal as heretofore stated, second by Mr. Bierman, unanimously <br />approved. <br />(b) Christ the King Church, 30635 Lorain Road. Proposal to increase <br />capacity of parkfng lot by add3ng thirteen additional spaces; approved by Planning <br />Counnission on July 26, 1983. BZD Cornmittee recommends approval. Mr. Woerpel moved <br />Council approve proposal as heretofore stated, second by Mr. Bierma.n, unanimou5ly <br />approved.
