Council Minutes of 6/7/83 _2- <br />4) The City has received approval from the Ohio Department of Traasportation for <br />another Comffiunity Uevelapment B1ock Grant Project, the 1480 tree planting at Grace <br />Road. It is anticipated that appraximately 80, four foot hig,h Austrian pines will <br />be planted.by the Department of Recreation for which they will be reimbursed. <br />5) Dalton, Dalton, Newport contract to prepare plans and specifications for sewer <br />iuaprovementa was executed and a notice to proceed issued. <br />6) A review meeting with ODOT, on the relocated S.R. 252 Project, was attended by <br />City Engineer and Lt. Gerry Krynak, who 3B in charge of traffic control maintenance. <br />Comnents were preaented and noted by ODOT. ODOT, in turn, requested a revision of <br />the prints to show the location of future sidewalks, if any ever were poured, at <br />the intersection of Butternut Ridge Road and relocated S.R. 252. <br />Mr. Woerpel asked if the City Engineer was still sticking to his decision to delay <br />tree planting along 1480 until Fall. Mr. Zurawski replied that on the contrary it <br />is the intent to proceed with tree planting as quickly as possible, specifying <br />balled trees, since the weather conditions are sti11 favorable. <br />Mr. McKay reported that he had received the Facility Plan packet of documents sub- <br />mitted to the Ohio EPA in order to meet the requirements for the Step 3 Grants and <br />the volume of water used by Fairview Park will be measured by water-meter readings <br />so this answers Mr. Wilamoaky's concerns as stated at the last Council Meeting. <br />Mr. Zurawski stated that the existing master meter, covering 80% of Fairview Park <br />users, would be semoved. A new master/monitor meter would be installed in the new <br />relief/interceptor sewer which would carry all the Fairview Park sanitary sewage <br />direetly to North Olmsted's Wastewater Treatment Plant. <br />Finance Director Boyle reported: 1) City received $366,140.04, from the City of <br />Cleveland, covering the last quarter of sewer billing. Billing was $400,666.79; <br />City of Cleveland charged $22,500 for billing and retained $12,020. They are <br />holding $35,659.84 for delinquent sewer billing. This is interesting because the <br />write-off over the past couple of years has averaged about $400. <br />2) The County Auditor has reconciled the first half of 1983 real estate taxes and <br />City received a check on May 31st in the amount of $1,178,961. City still has <br />$143,619 to collect from the State of Ohio, whieh usually comes in at the end of June. <br />3) June lst is semi-annual bond and coupon payment. June lst is all interegt; <br />December lst is interest and principle. Paid out $368,000 on interest of long term <br />obligation, using $30,000 of interest earned in the first six months and reduced <br />it to $338,000. Had about a million dollars on hand and purchased a treasury note at <br />9.204% for the period ending December lst. This will bring in another $30,000, plus <br />other investments, which should off-set about $60,000 of a million dollar bill. <br />4) Also received the first six months of special assess.ments in the asount of <br />$120,600; $380 of which were delinquencies. <br />5) If Council approves Ordinance No. 83-69, the eserow agreement, it will be at <br />National City Bank and the money will be invested in a federated, short term fund, <br />producing approxima.tely 8.1% to 8.2% interest. <br />Law Director Gareau reported: 1) Last week filed with the Eighth Appellate District <br />Court the brief in opposition to the appeal brought by members of the Fire Department <br />who filed on the pension case. <br />2) With respect to the William Patrick Viccarroni case, where the City was sued be- <br />cause his arrest record was not expunged, the City has prevailed in this case. <br />Mr. Viccarroni keeps writing, submitting briefs and motions, etc. Law Director has <br />? written Judge Ann Aldridge, indicating the City is going to ignore him because it <br />has already won the case and coincidentally dropped him a note telling him that the <br />case was over last December. Mr. Viccarroni responded by filing a notice of appeal <br />to the Sixth Circuit Court of Appeals in Cincinnati; will file amotion to dismiss <br />the appeal because it is not timely. <br />
