Council Minutes of 4/19/83 _3_ <br />2) With respect to the meeting with the Cleveland Water Department, it was <br />pointed out that Law Director Garesu does not believe that the City of Cleveland <br />has some sort of property right in the face of a water meter. Ttiis was indicated <br />to them and they responded tfiat if they had to, they would fiZe suit to stop us <br />from looking at their water meters. Both the City of Rocky River and City of <br />Strongsville presently do exactly that. Strongsville has adopted a program where <br />they ask the residents to duplicate their water bi11; they send a two card communi- <br />cation, one part asking the resident's cooperation by filling in the usage indicated <br />by the meter reading on the water bill, and matling back the properly filled in <br />card which has been pre-addressed and pre-stamped. This procedure is meeting with <br />a great deal of success. North Olmsted is trying to negotiate on the basis of what <br />it would cost to read the meters ourselves, transpose that reading onto a paper and <br />place it into the computer versus what Cleveland can do it for as far as a more <br />reasonable rate. <br />3) This Friday, will submit a brief to Common Pleas Court dealing with the Northern <br />Ohio Patrolmens' Benevolent Association versus the City of North Qlmsted. This is <br />a case where a police officer was suspended for f3ve days and is gresently question- <br />ing the legality of North Olmsted's Civil Service Commission's rule regarding the <br />right to an appeal for anything less than five days. The Ohio Revised Code gives <br />the right to appeal on any suspension. City does not. It is a question as to whether <br />North Olmsted has a right to do that as a chartered municipal corporation. <br />Safety Director Petre reported: 1) Received the resignation of Detective Keith Young <br />who has taken employment with the U.S. Secret Service. Since Detective Young was <br />the certified polygraph operator, this position needs to be filled. Sergeant Weston <br />has been transferred to the bureau. <br />2) With respect to Councilman Logan's request that Ordinance No. 82-123, regulating <br />the hours of use for drive-through windows of restaurants which operate within 200 <br />feet of a residential structure, a copy of the ordinance was forwarded to the <br />restaurant in question and a discussion was held with one of the unit managers. <br />Compliance is expected. Also, a newly proposed drive-through at another location <br />shall be advised by Building Commissioner Gundy. Occupancy permit has not yet been <br />issued but Mr. Gundy will make sure they are notified. <br />3) Mrs. Petrigac reported the problem of a few people receiving tickets for driving <br />through Best Products from Larain to Brookpark Extension to avotd the traffic control <br />device at the corner of Sparkp and Lorain. A telephone conversation with Mrs. Petrigac <br />did take place prior to Safety Director leavi.ng on vacation, at which. tiae he in- <br />dicated that he would research the Planning Commission minutes going back to when <br />there was great discussion with the business leaders in that area and interested <br />parties and that he would review, with the Chief, the actual nurnlaer of tickets written <br />at this location. Also discussed the possibility of a sign, but at no time was he <br />to report back to Council as the minutes so reflect. T[ie number of tickets written <br />for cutting through private property to avoid a traffic controi device for the period <br />from October, 1982 through the end of March, 1983, was 18; 7 of which were at this <br />location. Signage pxohibiting cut-through cannot legally be done by City on private prop <br />4) In early Ma.rch, 1983, became aware of the energy audit services provi.ded by the <br />Ohio Department of Energy. Gonversation with Program Manaw-r of OD and E resulted in <br />the city receiving consideration for the service they render along with a detailed <br />energy audit form. All requirements have been met and forms contpleted for the Police <br />Station, both Fire Stations and North Olmsted Recreation Complex. TEie audit forms <br />were sent back to the State on April 8th, 1983. Next step will involve an on-site <br />analysis by a certified energy analyst who will attempt to identify the systems that <br />are not using energy as efficietly as they should. A final report will then be sub- <br />mitted to the City with recommendations and appropriate cost effective energy con- <br />servation measures which the City should implement to eliminate waste.
