Council Minutes of 4/5/$3 <br />-Z- <br />Finance Directar Boyle reported: 1) Examiners from the Auditor of State's <br />office are conducting their audit of North OZTasted; pre-audit conference is <br />scheduled for tomorraw. Audit wf11 cover approximately from the end of 1980 <br />through the end of the first quarter of 1982. At pre-audit conference, will <br />discuss a number of items, including approximate cost; will report this to <br />Finance Committee at its next meeting. <br />2) Is trying to schedule a meeting the Cleveland Utilities Dtpartment and its <br />attorney, Mr. Rick Horvath, concerning semer billing and meter readings. Tiie <br />meeting is tentatively scheduled for Apri1 llth. They were ready to sue North <br />Olmsted a couple of weeks ago until Mr. BoyZe advised that the City of Cleveland <br />had been reading the meters; North Olmsted had not. Cleveland may still do the <br />May readings; will report to Council after the April 11th meeting. <br />3) The State Report for 1982 was filed prior to March 31st and of course was all <br />in balance; this will be part of the audit. <br />Law Director Gareau reported: 1) Has reviewed a letter from the City of Cleveland <br />regarding the reading of ineters and frankly does not agree with their Law Degart- <br />ment's statement that they have exclustve property right in the face of those <br />meters. When the water flows through North Olmsted's sewer system and the resi- <br />dents have the meters in their homes, he does not see how they have some sort of <br />a patent right or common law right in regard to those meters. Does not care whether <br />they file their law suits. Does not think that they are entitled to prohibit us <br />from reading to determine what, if any, amounts of sewage are consumed. <br />2) Is in receipt of another uotion filed in the Viccarroni Case. Mr. Viccarroni <br />does not seem to understand that he lost the case about fihree months ago and he <br />keeps filing motions. Rather than continue ignoring them, Law Director will <br />write a letter to the Judge and a letter to Mr. Viccarroni, informing him that <br />the case is over. <br />3) The Law Department argued the RTA Case in Cincinnati last Tuesday before a <br />three judge panel; one from Detroit, one from Memphis, Tennessee and a circuit <br />judge - none from Cuyahoga County. Were allowed to argue for one whole hour re- <br />garding the various aspects of anti-trust in this area. Since none of the judges <br />are from the State of Ohio, feels we will be looking at pure legal theory. The <br />panel of judges can take as much time as they need before making a ruliag. <br />Mr. Bierman, Chairman Recreatio4, Public Parks and Buildings Conmaittee reported: <br />1) Committee met March 28th with Members Saringer and Bierman present as well as <br />the Mayor, President Boehmer, Safety Director, Councilmen MeKay and Wilamosky, <br />and Mr. Sezonov from Dover Center Road. Committee discussed Ordinance No. 83-26 <br />and recommencb approval with the further recommendation that the Administration have <br />a public auction for the homes on Dover Road, with a minimum bid of $4,000. <br />Mrs. Petrigac, Chairman Long Range Planning Committee reported: 1) The Interim <br />Council Chamber Committee met Ma.rch 17th with the Mayor and Architect. Committee <br />finalized the wiring plan; decided an ceiling and side lighting on the columns on <br />the walls; finalized the floor wiring. Next decisions are the kind of light <br />fixtures; kind of wood molding around the ceiling beams and the type of effect on <br />the walls behind the couneil seating. The Ma.yor, the Architect and the Building <br />CoAmni.ssioner have assured the Committee that the building is movf:ng along very <br />rapidly and is a soundly constructed building for the money that has been spent. <br />A model of the new Counci2 Chambers is in the President's office if anyone would <br />like to inspect it.
