~. ~ <br />MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />OCTOBER 2, 1984 <br />Present: President James Boehmer, Councilmen Bierman, O'Grady, Petrigac, <br />Rademaker, Saringer, Tallon, tdilamosky. (Councilwoman Saringer <br />present at 8:50 P.M.) <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Clerk of Council Florence Campbell. <br />Meeting was called to order by President Boehmer at 8:05 P.M. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of Council Meeting of September 18, 1984, were approved. <br />President Boehmer announced that Ordinance Nos. 84-92 and 84-93 had been amended <br />and placed on the agenda tonight for second reading; Ordinance No. 84-90, had <br />been removed from the agenda. <br />Mayor Swietyniowski reported: 1) Explained a new program called "Operation HOME", <br />Help Ourselves Minimize Exploitation, which is designed to protect North Olmsted <br />residents from being victims of home repair fraud. <br />2) Announced that Fairview General Hospital was sponsoring a community health series <br />at the North Olmsted Senior Center on October 9th, November 5th and Januazy 16th; <br />programs are free and open to the public. Also, a public health nurse from the <br />Cuyahoga Health Department will be conducting a health, education and screening clinic <br />once a month at the Senior Citizens' Center. <br />3) Leaf pickup will begin October 15th and end December 15th with three complete <br />pickups city-wide. <br />Law Director Gareau reported: I) With respect to the status of the Police and <br />Fire Pension Disability Fund Case dealing with the City being assessed $386,OOQ, <br />the City had won in the lower court as well as in the Court of Appeals. The case <br />was appealed to the Supreme Court in June but the brief in support of jurisdiction <br />was never filed so the case is now concluded and will stand. <br />2) City also had a dispute. over the Kings' Path Condominium Case dealing with the <br />Med Center. The lower court had originally indicated that the City had to assist <br />in abating the nuisance that was created with respect to water accumulating in the <br />driveway. Law Director firmly believes this is a private nuisance and not a public <br />nuisance and appealed the case; it was then dismissed by the judge. There was <br />another appeal taken from that dismissal and wound up with too appeals in the Court <br />of Appeals. Kings' Path attorney has agreed to dismiss his appeal if the City of <br />North Olmsted dismisses its appeal. Law Director has agreed to do so. This leaves <br />the City in the position of not being responsible for helping to abate any nuisance <br />or participate in any problems that exist between the Med Center and Kings' Path <br />Condominium. <br />
