Council Minutes of 7/3/84 _2_ <br />Law Director Gareau reported: 1) In 1980 had filed a declaratory judgment action <br />with respect to the jail standards; submitted briefs; heard nothing until last <br />week. The Judge granted the motion for summary judgment on behalf of the State <br />of Ohio, even though the original jail standards that the City filed on, were <br />repealed. If a pretrial conference had been held, Law Director Gareau could have <br />established this fact. Since this was not done, Law Director will file a motion <br />to reconsider, bringing up the fact that the jail standards have been. repealed. <br />The reason for this action is that the Law Director does not want this to act as <br />precedence and have the court rule that the City of North Olmsted does not have <br />home rule powers to conduct it's own jail standards. <br />2) Have reached a tentative settlement with respect to the Great Northern Mall <br />assessed valuation cases. There were pending disputes on the assessed valuation for <br />the Mall for 1979, 1980, 1981, 1982 and 1983. This will mean somewhere in excess <br />of $100,000 this year, in additional revenues, with respect to all of these <br />pending cases. <br />Mrs. Saringer, Chairman Intro-Governmental Relations and Legislation Committee re- <br />ported: 1) Legislative Committee met earlier this evening with all members present <br />to discuss appointment of a council representative to serve on the Board of Review <br />with respect to the Taxation Code. At this time, with committee's unanimous approval, <br />Mrs. Saringer moved Council appoint Mr. Ronald Wilamosky to serve as council's repre- <br />sentative on the Board of Review, second by Mr. O'Grady, unanimously approved. <br />Mrs. Petrigac, Chairman Recreation, Public Parks and Buildings Committee as well as <br />Transportation Committee reported: 1) Reminded everyone that the Recreation Committee <br />of Council will be meeting on Thursday, at 7 P.M., to discuss the park memorial. <br />2) Landmarks Commission has met and Ordinance No. 84-58 covers the grant they are <br />applying for. This is a matching fund, which will be reimbursed. Chairman of the <br />Landmarks Commission is present tonight to answer any questions Council might have. <br />Mr. Tallon, Chairman Building, Zoning and Development Committee reported: 1) BZD <br />Committee met Thursday, June 28th at 8:05 P.M., with all members present as well <br />as Building Commissioner Gundy. Committee considered the following: <br />a. Bob Evan's Restaurant, Parcel No. 236-2-2, between Zayre/Rini <br />Shopping Center and Ponderosa/King's Path Condos, proposal to construct restaurant. <br />Mr. Tallon moved Council approve said construction proposal, as recommended by ARB, <br />second by Mr. Bierman, unanimously approved. <br />b. Cleveland Tux Shop, request for a change in design and reduction of <br />signage by omitting one sign and reducing the square footage of all others. BZD <br />Committee unanimously approves said proposal. Mr. Tallon moved Council approve <br />said proposal, approved by Planning Commission and ARB, second by Mr. Rademaker, <br />unanimously approved. <br />c. Eye Works/Tony Valore Builders, 26127 Lorain Road, proposal to con- <br />vert existing office building into an eye care center and builder's offices. <br />BZD Committee voted two to one for approval; Mr. Rademaker objected to the replace- <br />ment of the glass windows with the split block front and objected also to the lack of <br />landscaping. Mr. Rademaker explained his dissenting vote: the plans call for bricking <br />in all the windows that face Lorain Road and the drive into the property and he finds <br />that really offensive. Feels this will turn an attractive office building into some- <br />thing that looks more like a warehouse. All planned improvements face toward Brook- <br />park Road. Mr. Tallon moved Council approve Eye Works/Tony Valore Builders' pro- <br />posal, second by Mr. Bierman. Affirmative vote: Bierman, Tallon. Negative vote: <br />O'Grady, Petrigac, Rademaker, Saringer, Wilamosky. 2 Aye - 5 Nay - Motion failed. <br /> <br />
